| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 246, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 246.008 to read as follows: |

| 12 | 12 | | Sec. 246.008. CONSTRUCTION OR DEVELOPMENT OF CERTAIN |
|---|
| 13 | 13 | | FACILITIES. (a) This section applies only to a facility located in |
|---|
| 14 | 14 | | the extraterritorial jurisdiction of a municipality with a |
|---|
| 15 | 15 | | population of more than 775,000. |
|---|
| 16 | 16 | | (b) Notwithstanding Chapter 245, Local Government Code, a |
|---|
| 17 | 17 | | person that has obtained a permit as described by Section 245.001, |
|---|
| 18 | 18 | | Local Government Code, including approval of a site plan, for a |
|---|
| 19 | 19 | | facility from a municipality may develop the site in accordance |
|---|
| 20 | 20 | | with the municipal ordinances, regulations, and rules, including an |
|---|
| 21 | 21 | | impervious lot coverage regulation, in effect on the earlier of the |
|---|
| 22 | 22 | | date the original permit was issued or the site plan was approved |
|---|
| 23 | 23 | | and notwithstanding the issuance of a subsequent permit or a change |
|---|
| 24 | 24 | | in those ordinances, regulations, or rules. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2015. |
