A BILL TO BE ENTITLED
AN ACT
relating to the construction or development of certain continuing
care facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 246, Health and Safety
Code, is amended by adding Section 246.008 to read as follows:
Sec. 246.008. CONSTRUCTION OR DEVELOPMENT OF CERTAIN
FACILITIES. (a) This section applies only to a facility located in
the extraterritorial jurisdiction of a municipality with a
population of more than 775,000.
(b) Notwithstanding Chapter 245, Local Government Code, a
person that has obtained a permit as described by Section 245.001,
Local Government Code, including approval of a site plan, for a
facility from a municipality may develop the site in accordance
with the municipal ordinances, regulations, and rules, including an
impervious lot coverage regulation, in effect on the earlier of the
date the original permit was issued or the site plan was approved
and notwithstanding the issuance of a subsequent permit or a change
in those ordinances, regulations, or rules.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
