104 AN ACT
115 relating to regulation of certain conduct by discount health care
126 program operators, or concerning discount health care programs,
137 that relates to prescription drugs or prescription drug benefits;
148 authorizing administrative and civil penalties.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Subchapter B, Chapter 562, Insurance Code, is
1711 amended by adding Sections 562.055 and 562.056 to read as follows:
1812 Sec. 562.055. NETWORK PARTICIPATION REQUIREMENTS. (a) It
1913 is an unfair method of competition or an unfair or deceptive act or
2014 practice in the business of discount health care programs for a
2115 discount health care program operator or an affiliate or agent of a
2216 discount health care program operator to require a pharmacy or
2317 pharmacist to:
2418 (1) participate in a specified provider network as a
2519 condition of processing a claim for prescription drugs under the
2620 discount health care program; or
2721 (2) participate in, or process claims under, a
2822 discount health care program as a condition of participation in a
2923 provider network.
3024 (b) A discount health care program operator is not legally
3125 liable for any act or omission of an agent of the operator in
3226 violation of Subsection (a).
3327 Sec. 562.056. CERTAIN METHODS OF PROMOTIONS. (a) It is an
3428 unfair method of competition or an unfair or deceptive act or
3529 practice in the business of discount health care programs for a
3630 discount health care program operator to pay any consideration to a
3731 health care services provider or employee of a health care services
3832 provider:
3933 (1) to encourage an individual to claim a discount for
4034 prescription drugs under a discount health care program; or
4135 (2) to include discount health care program
4236 information on a prescription for a drug or in materials
4337 accompanying the prescription.
4438 (b) It is an unfair method of competition or an unfair or
4539 deceptive act or practice in the business of discount health care
4640 programs for a discount health care program operator to provide a
4741 person with written prescription forms that could reasonably
4842 mislead an individual to believe that the discount health care
4943 program is health insurance or provides coverage similar to health
5044 insurance.
5145 SECTION 2. Subchapter D, Chapter 4151, Insurance Code, is
5246 amended by adding Section 4151.154 to read as follows:
5347 Sec. 4151.154. DISCOUNT HEALTH CARE PROGRAMS. A pharmacy
5448 benefit manager may not require a pharmacist or pharmacy to:
5549 (1) accept or process a claim for prescription drugs
5650 under a discount health care program as defined by Section 7001.001
5751 unless the pharmacist or pharmacy agrees in writing to accept or
5852 process the claim;
5953 (2) participate in a specified provider network as a
6054 condition of processing a claim for prescription drugs under a
6155 discount health care program; or
6256 (3) participate in, or process claims under, a
6357 discount health care program as a condition of participation in a
6458 provider network.
6559 SECTION 3. (a) Except as provided by Subsection (b) of this
6660 section, the changes in law made by this Act apply only to conduct
6761 that occurs on or after the effective date of this Act. Conduct that
6862 occurs before the effective date of this Act is governed by the law
6963 as it existed when the conduct occurred, and the former law is
7064 continued in effect for that purpose.
7165 (b) The changes in law made by this Act apply only to a claim
7266 filed under a discount health care program on or after the effective
7367 date of this Act. A claim filed before the effective date of this
7468 Act is governed by the law as it existed immediately before the
7569 effective date of this Act, and that law is continued in effect for
7670 that purpose.
7771 SECTION 4. This Act takes effect September 1, 2015.
