115 relating to the Jobs and Education for Texans Grant Program.
126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Section 134.001, Education Code, is amended by
148 adding Subdivision (1) to read as follows:
159 (1) "Commission" means the Texas Workforce
1610 Commission.
1711 SECTION 2. Section 134.002(a), Education Code, is amended
1812 to read as follows:
1913 (a) The commission [comptroller] shall establish and
2014 administer the Jobs and Education for Texans (JET) fund as a
2115 dedicated account in the general revenue fund.
2216 SECTION 3. Section 134.003, Education Code, is amended to
2317 read as follows:
2418 Sec. 134.003. ADVISORY BOARD. (a) An advisory board of
2519 education and workforce stakeholders is created to assist the
2620 commission [comptroller] in administering this chapter.
2721 (b) The advisory board is composed of six [seven] members
2822 who serve two-year terms and are appointed as follows:
2923 (1) one member appointed by the governor;
3024 (2) one member appointed by the lieutenant governor;
3125 (3) one member appointed by the speaker of the house of
3226 representatives;
3327 (4) one member appointed by the Texas Higher Education
3428 Coordinating Board;
3529 (5) one member appointed by the commission [Texas
3630 Workforce Commission]; and
3731 (6) the chair of the commission [one member of the
3832 public appointed by the comptroller; and
3933 [(7) the comptroller], who serves as the presiding
4034 officer.
4135 (c) The advisory board shall meet at least once each
4236 quarter, or as needed, to review received applications and
4337 recommend awarding grants under this chapter.
4438 SECTION 4. Section 134.004, Education Code, is amended to
4539 read as follows:
4640 Sec. 134.004. JOBS AND EDUCATION FOR TEXANS (JET) GRANT
4741 PROGRAM. (a) The commission [comptroller] shall establish and
4842 administer the Jobs and Education for Texans (JET) Grant Program to
4943 provide grants to public junior colleges, [and] public technical
5044 institutes, and independent school districts described under
5145 Section 134.007 that apply to the advisory board in the manner
5246 prescribed by the advisory board. The commission [comptroller]
5347 shall award the grants on the advice and recommendations of the
5448 advisory board.
5549 (b) Grants may be awarded under this chapter from the Jobs
5650 and Education for Texans (JET) fund to defray the start-up costs
5751 associated with the development of new career and technical
5852 education programs at public junior colleges, [and] public
5953 technical institutes, and independent school districts described
6054 under Section 134.007 that meet the requirements of Section
6155 134.006.
6256 SECTION 5. Sections 134.006(a), (c), and (d), Education
6357 Code, are amended to read as follows:
6458 (a) The commission [comptroller] may award a grant for the
6559 development of new career and technical education courses or
6660 programs at public junior colleges, [and] public technical
6761 institutes, and independent school districts.
6862 (c) In awarding a grant under this section, the commission
6963 [comptroller] shall primarily consider the potential economic
7064 returns to the state from the development of the career and
7165 technical education course or program. The commission
7266 [comptroller] may also consider whether the course or program:
7367 (1) is part of a new, emerging industry or high-demand
7468 occupation;
7569 (2) offers new or expanded dual credit career and
7670 technical educational opportunities in public high schools; or
7771 (3) is provided in cooperation with other public
7872 junior colleges or public technical institutes across existing
7973 service areas.
8074 (d) To be eligible to receive a grant under this section, a
8175 public junior college, [or] public technical institute, or
8276 independent school district described under Section 134.007 must
8377 provide matching funds in accordance with rules adopted under
8478 Section 134.008. The matching funds may be obtained from any source
8579 available to the public junior college, public [or] technical
8680 institute, or independent school district, including [in-kind
8781 contributions,] industry consortia, community or foundation
8882 grants, individual contributions, and local governmental agency
8983 operating funds.
9084 SECTION 6. Chapter 134, Education Code, is amended by
9185 adding Section 134.007 to read as follows:
9286 Sec. 134.007. GRANTS AWARDED TO INDEPENDENT SCHOOL
9387 DISTRICT. The commission may award a grant to an independent school
9488 district under this chapter if the district has entered into a
9589 partnership with a public junior college or public technical
9690 institute for the purpose of:
9791 (1) promoting career and technical education to the
9892 district's students; or
9993 (2) offering dual credit courses to the district's
10094 students.
10195 SECTION 7. Section 134.008, Education Code, is amended to
10296 read as follows:
10397 Sec. 134.008. RULES. The commission [comptroller] shall
10498 adopt rules as necessary for the administration of this chapter.
10599 SECTION 8. (a) Not later than September 1, 2015:
106100 (1) the administration of the Jobs and Education for
107101 Texans Grant Program shall be transferred from the comptroller to
108102 the Texas Workforce Commission;
109103 (2) all rules, forms, policies, procedures, or
110104 decisions of the comptroller that are related to the Jobs and
111105 Education for Texans Grant Program are continued in effect as
112106 rules, forms, policies, procedures, or decisions of the Texas
113107 Workforce Commission until superseded by a rule or other
114108 appropriate act of the Texas Workforce Commission;
115109 (3) all money, obligations, memoranda of
116110 understanding, leases, rights, and contracts, including grant
117111 agreements, of the comptroller related to the Jobs and Education
118112 for Texans Grant Program are transferred to the Texas Workforce
119113 Commission, and the Texas Workforce Commission assumes, without a
120114 change in status, the position of the comptroller in all
121115 transferred contracts, including grant agreements, related to the
122116 Jobs and Education for Texans Grant Program;
123117 (4) records in the custody of the comptroller related
124118 to the Jobs and Education for Texans Grant Program are transferred
125119 to and become the property of the Texas Workforce Commission; and
126120 (5) a reference in law or administrative rule to the
127121 comptroller relating to the administration of the Jobs and
128122 Education for Texans Grant Program means the Texas Workforce
129123 Commission.
130124 (b) Before the transfer of the administration of the Jobs
131125 and Education for Texans Grant Program, the comptroller and the
132126 Texas Workforce Commission shall coordinate the transfer of powers
133127 and duties, including records, appropriations, disbursements,
134128 compliance audits, monitoring and enforcement, and other items, to
135129 ensure a smooth transition.
136130 SECTION 9. An independent school district may be awarded a
137131 grant in accordance with Section 134.007, Education Code, as added
138132 by this Act, beginning with the 2016-2017 academic year.
139133 SECTION 10. This Act takes effect immediately if it
140134 receives a vote of two-thirds of all the members elected to each
141135 house, as provided by Section 39, Article III, Texas Constitution.
142136 If this Act does not receive the vote necessary for immediate
143137 effect, this Act takes effect September 1, 2015.
