9- relating to emergency medical air transportation funding.
6+ relating to funding for trauma facilities, emergency medical
7+ services, and emergency medical air transportation.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Chapter 773, Health and Safety Code, is amended
1210 by adding Subchapter I to read as follows:
1311 SUBCHAPTER I. EMERGENCY MEDICAL AIR TRANSPORTATION FUNDING
1412 Sec. 773.221. DEFINITIONS. In this subchapter:
1513 (1) "Account" means the emergency medical air
1614 transportation account created under Section 773.222.
1715 (2) "Commission" means the Health and Human Services
1816 Commission.
1917 (3) "Commissioner" means the commissioner of state
2018 health services.
2119 Sec. 773.222. EMERGENCY MEDICAL AIR TRANSPORTATION
2220 ACCOUNT. (a) The emergency medical air transportation account is
2321 established as a dedicated account in the general revenue fund. The
2422 account is composed of:
2523 (1) money deposited to the credit of the account under
2624 Section 542.4031, Transportation Code; and
2725 (2) notwithstanding Section 404.071, Government Code,
2826 interest earned on the investment of money in the account and
2927 depository interest allocable to the account.
3028 (b) Money in the account may be appropriated only to the
3129 department for the purposes described by Subsection (c).
3230 (c) The commissioner may:
3331 (1) use the money appropriated from the account to
3432 provide funding, in addition to funding available from other
3533 sources, for emergency medical air transportation; and
3634 (2) after consulting with the executive commissioner,
3735 transfer the money appropriated from the account to the commission
3836 to:
3937 (A) provide reimbursements under the medical
4038 assistance program under Chapter 32, Human Resources Code, to
4139 providers of emergency medical air transportation services,
4240 including reimbursement enhancements to the statewide dollar
4341 amount rate used to reimburse designated air ambulance services
4442 under the program; and
4543 (B) maximize the receipt of federal funds under
4644 the medical assistance program under Chapter 32, Human Resources
4745 Code, to the extent possible.
48- SECTION 2. Section 542.4031(g), Transportation Code, is

55+ SECTION 4. Section 542.4031(g), Transportation Code, is
4956 amended to read as follows:
5057 (g) Of the money received by the comptroller under this
5158 section, the comptroller shall deposit:
5259 (1) 50 [67] percent to the credit of the undedicated
5360 portion of the general revenue fund; [and]
5461 (2) 33 percent to the credit of the designated trauma
5562 facility and emergency medical services account under Section
5663 780.003, Health and Safety Code; and
5764 (3) 17 percent to the credit of the designated
5865 emergency medical air transportation account under Section
5966 773.222, Health and Safety Code.
60- SECTION 3. Section 542.4031(g), Transportation Code, as
67+ SECTION 5. Section 542.406(c), Transportation Code, is
68+ amended to read as follows:
69+ (c) Not later than the 60th day after the end of a local
70+ authority's fiscal year, after deducting amounts the local
71+ authority is authorized by Subsection (d) to retain, the local
72+ authority shall:
73+ (1) send 50 percent of the revenue derived from civil
74+ or administrative penalties collected by the local authority under
75+ this section to the comptroller for deposit to the credit of the
76+ designated [regional] trauma facility and emergency medical
77+ services account established under Section 780.003 [782.002],
78+ Health and Safety Code; and
79+ (2) deposit the remainder of the revenue in a special
80+ account in the local authority's treasury that may be used only to
81+ fund traffic safety programs, including pedestrian safety
82+ programs, public safety programs, intersection improvements, and
83+ traffic enforcement.
84+ SECTION 6. Section 707.008(a), Transportation Code, is
85+ amended to read as follows:
86+ (a) Not later than the 60th day after the end of a local
87+ authority's fiscal year, after deducting amounts the local
88+ authority is authorized by Subsection (b) to retain, the local
89+ authority shall:
90+ (1) send 50 percent of the revenue derived from civil
91+ or administrative penalties collected by the local authority under
92+ this section to the comptroller for deposit to the credit of the
93+ designated [regional] trauma facility and emergency medical
94+ services account established under Section 780.003 [782.002],
95+ Health and Safety Code; and
96+ (2) deposit the remainder of the revenue in a special
97+ account in the local authority's treasury that may be used only to
98+ fund traffic safety programs, including pedestrian safety
99+ programs, public safety programs, intersection improvements, and
100+ traffic enforcement.
101+ SECTION 7. The following laws are repealed:
102+ (1) Section 780.003(c), Health and Safety Code; and
103+ (2) Chapter 782, Health and Safety Code, as amended by
104+ S.B. No. 219, Acts of the 84th Legislature, Regular Session, 2015.
105+ SECTION 8. On the effective date of this Act:
106+ (1) the regional trauma account established under
107+ Chapter 782, Health and Safety Code, is abolished; and
108+ (2) any unexpended and unobligated balance of money in
109+ the regional trauma account is transferred to the designated trauma
110+ facility and emergency medical services account established under
111+ Section 780.003, Health and Safety Code.
112+ SECTION 9. Section 542.4031(g), Transportation Code, as
61113 amended by this Act, applies only to the distribution of revenue
62114 collected on or after the effective date of this Act. The
63115 distribution of revenue collected before the effective date of this
64116 Act is governed by the law in effect at the time the revenue was
65117 collected, and that law is continued in effect for the purpose of
66118 the distribution of that revenue.
67- SECTION 4. This Act takes effect September 1, 2015.
