| 7 | 7 | | relating to increasing the amount of burial benefits required to be |

| 8 | 8 | | paid by an insurance carrier under the workers' compensation |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 408.186(a), Labor Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) If the death of an employee results from a compensable |
|---|
| 14 | 14 | | injury, the insurance carrier shall pay to the person who incurred |
|---|
| 15 | 15 | | liability for the costs of burial the lesser of: |
|---|
| 16 | 16 | | (1) the actual costs incurred for reasonable burial |
|---|
| 17 | 17 | | expenses; or |
|---|
| 18 | 18 | | (2) $10,000 [$6,000]. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 20 | 20 | | claim for workers' compensation burial benefits based on a |
|---|
| 21 | 21 | | compensable injury that occurs on or after the effective date of |
|---|
| 22 | 22 | | this Act. A claim based on a compensable injury that occurs before |
|---|
| 23 | 23 | | the effective date of this Act is governed by the law in effect on |
|---|
| 24 | 24 | | the date the compensable injury occurred, and the former law is |
|---|
| 25 | 25 | | continued in effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2015. |
