| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 140, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 140.012 to read as follows: |
|---|
| 12 | 12 | | Sec. 140.012. POSTING OF FINANCIAL INFORMATION BY SPECIAL |
|---|
| 13 | 13 | | PURPOSE DISTRICT. (a) In this section, "special purpose district" |
|---|
| 14 | 14 | | means a political subdivision of this state with boundaries that |
|---|
| 15 | 15 | | are not statewide, other than a municipality, county, or |
|---|
| 16 | 16 | | independent school district. |
|---|
| 17 | 17 | | (b) A special purpose district shall maintain a financial |
|---|
| 18 | 18 | | transparency Internet website and shall post to that website: |
|---|
| 19 | 19 | | (1) the district's budget for the district's current |
|---|
| 20 | 20 | | fiscal year and the three preceding fiscal years; |
|---|
| 21 | 21 | | (2) a comprehensive financial report for the |
|---|
| 22 | 22 | | district's three preceding fiscal years; and |
|---|
| 23 | 23 | | (3) an electronic checking account transaction |
|---|
| 24 | 24 | | register with information for the district's current fiscal year |
|---|
| 25 | 25 | | and the three preceding fiscal years that meets the requirements of |
|---|
| 26 | 26 | | Subsections (c), (d), and (e). |
|---|
| 27 | 27 | | (c) A special purpose district shall maintain the |
|---|
| 28 | 28 | | transaction register for the district's checking account in a |
|---|
| 29 | 29 | | searchable electronic spreadsheet format. Except as provided by |
|---|
| 30 | 30 | | Subsection (d), the electronic checking account transaction |
|---|
| 31 | 31 | | register must include for each check written from a district |
|---|
| 32 | 32 | | checking account: |
|---|
| 33 | 33 | | (1) the transaction amount; |
|---|
| 34 | 34 | | (2) the check number; |
|---|
| 35 | 35 | | (3) the name of the payee; and |
|---|
| 36 | 36 | | (4) a statement of the purpose of the expenditure for |
|---|
| 37 | 37 | | which the check was written. |
|---|
| 38 | 38 | | (c-1) Notwithstanding Subsection (c), a special purpose |
|---|
| 39 | 39 | | district's electronic checking account transaction register must |
|---|
| 40 | 40 | | contain the information required by Subsections (c)(1), (2), and |
|---|
| 41 | 41 | | (3) for each check dated before January 1, 2016. A district's |
|---|
| 42 | 42 | | electronic checking account transaction register must contain the |
|---|
| 43 | 43 | | information required by Subsections (c)(1) through (4) for each |
|---|
| 44 | 44 | | check dated on or after January 1, 2016. This subsection expires |
|---|
| 45 | 45 | | December 31, 2019. |
|---|
| 46 | 46 | | (d) A special purpose district may not include in the |
|---|
| 47 | 47 | | district's electronic checking account transaction register a |
|---|
| 48 | 48 | | check issued to a district employee in payment of a workers' |
|---|
| 49 | 49 | | compensation income benefit, medical benefit, death benefit, or |
|---|
| 50 | 50 | | burial benefit that is issued by a special purpose district |
|---|
| 51 | 51 | | operating as a self-insurer under Chapter 504, Labor Code. |
|---|
| 52 | 52 | | (e) A special purpose district shall update the electronic |
|---|
| 53 | 53 | | checking account transaction register at least once each month, not |
|---|
| 54 | 54 | | later than the 90th day after the closing date of the most recent |
|---|
| 55 | 55 | | monthly statement for the checking account. |
|---|
| 56 | 56 | | SECTION 2. This Act takes effect January 1, 2016. |
