77 relating to the availability of certain special purpose district
88 financial information on a district's Internet website.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 140, Local Government Code, is amended
1111 by adding Section 140.012 to read as follows:
1212 Sec. 140.012. POSTING OF FINANCIAL INFORMATION BY SPECIAL
1313 PURPOSE DISTRICT. (a) In this section, "special purpose district"
1414 means a political subdivision of this state with boundaries that
1515 are not statewide, other than a municipality, county, or
1616 independent school district.
1717 (b) A special purpose district shall maintain a financial
1818 transparency Internet website and shall post to that website:
1919 (1) the district's budget for the district's current
2020 fiscal year and the three preceding fiscal years;
2121 (2) a comprehensive financial report for the
2222 district's three preceding fiscal years; and
2323 (3) an electronic checking account transaction
2424 register with information for the district's current fiscal year
2525 and the three preceding fiscal years that meets the requirements of
2626 Subsections (c), (d), and (e).
2727 (c) A special purpose district shall maintain the
2828 transaction register for the district's checking account in a
2929 searchable electronic spreadsheet format. Except as provided by
3030 Subsection (d), the electronic checking account transaction
3131 register must include for each check written from a district
3232 checking account:
3333 (1) the transaction amount;
3434 (2) the check number;
3535 (3) the name of the payee; and
3636 (4) a statement of the purpose of the expenditure for
3737 which the check was written.
3838 (c-1) Notwithstanding Subsection (c), a special purpose
3939 district's electronic checking account transaction register must
4040 contain the information required by Subsections (c)(1), (2), and
4141 (3) for each check dated before January 1, 2016. A district's
4242 electronic checking account transaction register must contain the
4343 information required by Subsections (c)(1) through (4) for each
4444 check dated on or after January 1, 2016. This subsection expires
4545 December 31, 2019.
4646 (d) A special purpose district may not include in the
4747 district's electronic checking account transaction register a
4848 check issued to a district employee in payment of a workers'
4949 compensation income benefit, medical benefit, death benefit, or
5050 burial benefit that is issued by a special purpose district
5151 operating as a self-insurer under Chapter 504, Labor Code.
5252 (e) A special purpose district shall update the electronic
5353 checking account transaction register at least once each month, not
5454 later than the 90th day after the closing date of the most recent
5555 monthly statement for the checking account.
5656 SECTION 2. This Act takes effect January 1, 2016.
