88 AN ACT
99 relating to the authority of certain municipalities to pledge
1010 revenue from the municipal hotel occupancy tax for the payment of
1111 obligations related to hotel projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 351.102(b), Tax Code, is amended to read
1414 as follows:
1515 (b) An eligible central municipality, [or] a municipality
1616 with a population of 173,000 or more that is located within two or
1717 more counties, or a municipality with a population of 96,000 or more
1818 that is located in a county that borders Lake Palestine or contains
1919 the headwaters of the San Gabriel River may pledge the revenue
2020 derived from the tax imposed under this chapter from a hotel project
2121 that is owned by or located on land owned by or that will be owned by
2222 the municipality or, in an eligible central municipality, by a
2323 nonprofit corporation acting on behalf of an eligible central
2424 municipality, and that is located within 1,000 feet of a convention
2525 center facility owned by the municipality for the payment of bonds
2626 or other obligations issued or incurred to acquire, lease,
2727 construct, and equip the hotel and any facilities ancillary to the
2828 hotel, including convention center entertainment-related
2929 facilities, meeting spaces, public spaces, including open public
3030 spaces used for connectivity, plazas, restaurants, shops, street
3131 and water and sewer infrastructure, and parking facilities within
3232 1,000 feet of the hotel or convention center facility. For bonds or
3333 other obligations issued under this subsection, an eligible central
3434 municipality or a municipality described by this subsection [with a
3535 population of 173,000 or more that is located within two counties]
3636 may only pledge revenue or other assets of the hotel project
3737 benefiting from those bonds or other obligations.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2015.
