9 | 9 | | relating to the authority of certain municipalities to pledge |

10 | 10 | | revenue from the municipal hotel occupancy tax for the payment of |
---|
11 | 11 | | obligations related to hotel projects. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 351.102(b), Tax Code, is amended to read |
---|
14 | 14 | | as follows: |
---|
15 | 15 | | (b) An eligible central municipality, [or] a municipality |
---|
16 | 16 | | with a population of 173,000 or more that is located within two or |
---|
17 | 17 | | more counties, or a municipality with a population of 96,000 or more |
---|
18 | 18 | | that is located in a county that borders Lake Palestine or contains |
---|
19 | 19 | | the headwaters of the San Gabriel River may pledge the revenue |
---|
20 | 20 | | derived from the tax imposed under this chapter from a hotel project |
---|
21 | 21 | | that is owned by or located on land owned by or that will be owned by |
---|
22 | 22 | | the municipality or, in an eligible central municipality, by a |
---|
23 | 23 | | nonprofit corporation acting on behalf of an eligible central |
---|
24 | 24 | | municipality, and that is located within 1,000 feet of a convention |
---|
25 | 25 | | center facility owned by the municipality for the payment of bonds |
---|
26 | 26 | | or other obligations issued or incurred to acquire, lease, |
---|
27 | 27 | | construct, and equip the hotel and any facilities ancillary to the |
---|
28 | 28 | | hotel, including convention center entertainment-related |
---|
29 | 29 | | facilities, meeting spaces, public spaces, including open public |
---|
30 | 30 | | spaces used for connectivity, plazas, restaurants, shops, street |
---|
31 | 31 | | and water and sewer infrastructure, and parking facilities within |
---|
32 | 32 | | 1,000 feet of the hotel or convention center facility. For bonds or |
---|
33 | 33 | | other obligations issued under this subsection, an eligible central |
---|
34 | 34 | | municipality or a municipality described by this subsection [with a |
---|
35 | 35 | | population of 173,000 or more that is located within two counties] |
---|
36 | 36 | | may only pledge revenue or other assets of the hotel project |
---|
37 | 37 | | benefiting from those bonds or other obligations. |
---|
38 | 38 | | SECTION 2. This Act takes effect immediately if it receives |
---|
39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
---|
40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
---|
42 | 42 | | Act takes effect September 1, 2015. |
