11	5		relating to lane restrictions for certain motor vehicles in highway
12	6		construction or maintenance work zones.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Subchapter B, Chapter 545, Transportation Code,
15	9		is amended by adding Section 545.0653 to read as follows:
16	10		Sec. 545.0653. RESTRICTION ON USE OF HIGHWAY IN MAINTENANCE
17	11		OR CONSTRUCTION WORK ZONE. (a) In this section:
18	12		(1) "Commercial motor vehicle" has the meaning
19	13		assigned by Section 548.001.
20	14		(2) "Construction or maintenance work zone" has the
21	15		meaning assigned by Section 472.022.
22	16		(3) "Department" means the Texas Department of
23	17		Transportation.
24	18		(4) "Executive director" means the executive director
25	19		of the department.
26	20		(b) The executive director or the executive director's
27	21		designee may restrict a commercial motor vehicle to a specific lane
28	22		of traffic in a construction or maintenance work zone for a highway
29	23		that is part of the state highway system if the executive director
30	24		or the executive director's designee determines that, based on a
31	25		traffic study performed by the department to evaluate the effect of
32	26		the restriction, the restriction is necessary to improve safety.
33	27		(c) The department shall erect and maintain official
34	28		traffic control devices necessary to implement and enforce a lane
35	29		restriction imposed under this section. A lane restriction may not
36	30		be enforced until the appropriate traffic control devices are in
37	31		place.
38	32		(d) The executive director or the executive director's
39	33		designee may rescind a lane restriction imposed under this section
40	34		at any time that the executive director or the executive director's
41	35		designee determines that the restriction is no longer necessary to
42	36		improve safety.
43	37		(e) A lane restriction imposed under this section expires
44	38		when the lane that is subject to the restriction is no longer in a
45	39		construction or maintenance work zone.
46	40		(f) The department shall remove traffic control devices
47	41		erected under this section if the lane restriction is rescinded
48	42		under Subsection (d) or expires under Subsection (e).
49	43		SECTION 2. This Act takes effect September 1, 2015.
