115 relating to lane restrictions for certain motor vehicles in highway
126 construction or maintenance work zones.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subchapter B, Chapter 545, Transportation Code,
159 is amended by adding Section 545.0653 to read as follows:
1610 Sec. 545.0653. RESTRICTION ON USE OF HIGHWAY IN MAINTENANCE
1711 OR CONSTRUCTION WORK ZONE. (a) In this section:
1812 (1) "Commercial motor vehicle" has the meaning
1913 assigned by Section 548.001.
2014 (2) "Construction or maintenance work zone" has the
2115 meaning assigned by Section 472.022.
2216 (3) "Department" means the Texas Department of
2317 Transportation.
2418 (4) "Executive director" means the executive director
2519 of the department.
2620 (b) The executive director or the executive director's
2721 designee may restrict a commercial motor vehicle to a specific lane
2822 of traffic in a construction or maintenance work zone for a highway
2923 that is part of the state highway system if the executive director
3024 or the executive director's designee determines that, based on a
3125 traffic study performed by the department to evaluate the effect of
3226 the restriction, the restriction is necessary to improve safety.
3327 (c) The department shall erect and maintain official
3428 traffic control devices necessary to implement and enforce a lane
3529 restriction imposed under this section. A lane restriction may not
3630 be enforced until the appropriate traffic control devices are in
3731 place.
3832 (d) The executive director or the executive director's
3933 designee may rescind a lane restriction imposed under this section
4034 at any time that the executive director or the executive director's
4135 designee determines that the restriction is no longer necessary to
4236 improve safety.
4337 (e) A lane restriction imposed under this section expires
4438 when the lane that is subject to the restriction is no longer in a
4539 construction or maintenance work zone.
4640 (f) The department shall remove traffic control devices
4741 erected under this section if the lane restriction is rescinded
4842 under Subsection (d) or expires under Subsection (e).
4943 SECTION 2. This Act takes effect September 1, 2015.
