| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Chapter 51, Transportation Code, is amended by | |
| 10 | 10 | adding Section 51.015 to read as follows: | |
| 11 | 11 | Sec. 51.015. FUNDING ASSISTANCE. (a) The commission may | |
| 12 | 12 | use state funds, including undedicated portions of the state | |
| 13 | 13 | highway fund, to: | |
| 14 | 14 | (1) assist the United States Army Corps of Engineers | |
| 15 | 15 | with the costs of maintenance and supplemental dredging activities | |
| 16 | 16 | for the Gulf Intracoastal Waterway; or | |
| 17 | 17 | (2) fund capital projects to repair, improve, or | |
| 18 | 18 | replace infrastructure facilities, as specified by the commission, | |
| 19 | 19 | along the Gulf Intracoastal Waterway, and fund studies to determine | |
| 20 | 20 | the feasibility of capital projects. | |
| 21 | 21 | (b) The commission may authorize the executive director of | |
| 22 | 22 | the department or the executive director's designee to enter into | |
| 23 | 23 | agreements with the United States Army Corps of Engineers under | |
| 24 | 24 | this section. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2015. |
