8	8	AN ACT
9	9	relating to an exemption from length limitations for certain
10	10	vehicles or combinations of vehicles used to transport harvest
11	11	machines.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 622.902, Transportation Code, is amended
14	14	to read as follows:
15	15	Sec. 622.902. LENGTH EXCEPTIONS. The length limitations
16	16	provided by Sections 621.203 to 621.205 do not apply to:
17	17	(1) machinery used exclusively for drilling water
18	18	wells, including machinery that is itself a unit or that is a unit
19	19	mounted on a conventional vehicle or chassis;
20	20	(2) a vehicle owned or operated by a public, private,
21	21	or volunteer fire department;
22	22	(3) a vehicle or combination of vehicles operated
23	23	exclusively in the territory of a municipality or to a combination
24	24	of vehicles operated by a municipality in a suburb adjoining the
25	25	municipality in which the municipality has been using the equipment
26	26	or similar equipment in connection with an established service to
27	27	the suburb;
28	28	(4) a truck-tractor, truck-tractor combination, or
29	29	truck-trailer combination exclusively transporting machinery,
30	30	materials, and equipment used in the construction, operation, and
31	31	maintenance of facilities, including pipelines, that are used for
32	32	the discovery, production, and processing of natural gas or
33	33	petroleum;
34	34	(5) a drive-away saddlemount vehicle transporter
35	35	combination or a drive-away saddlemount with fullmount vehicle
36	36	transporter combination, as defined by 23 C.F.R. Part 658 or its
37	37	successor, if:
38	38	(A) the overall length of the combination is not
39	39	longer than 97 feet; and
40	40	(B) the combination does not have more than three
41	41	saddlemounted vehicles if the combination does not include more
42	42	than one fullmount vehicle;
43	43	(6) the combination of a tow truck and another vehicle
44	44	or vehicle combination if:
45	45	(A) the other vehicle or vehicle combination
46	46	cannot be normally or safely driven or was abandoned on a highway;
47	47	and
48	48	(B) the tow truck is towing the other vehicle or
49	49	vehicle combination directly to the nearest authorized place of
50	50	repair, terminal, or destination of unloading; [or]
51	51	(7) a vehicle or combination of vehicles used to
52	52	transport a harvest machine [combine] that is used in farm custom
53	53	harvesting operations on a farm if the overall length of the vehicle
54	54	or combination is not longer than[:
55	55	[(A)] 75 feet [if the vehicle is traveling on a
56	56	highway that is part of the national system of interstate and
57	57	defense highways or the federal aid primary highway system]; or
58	58	(8) a truck-tractor operated in combination with a
59	59	semitrailer and trailer or semitrailer and semitrailer if:
60	60	(A) the combination is used to transport a
61	61	harvest machine that is used in farm custom harvesting operations
62	62	on a farm;
63	63	(B) the overall length of the combination,
64	64	excluding the length of the truck-tractor, is not longer than
65	65	81-1/2 feet; and
66	66	(C) the combination [if the vehicle] is not
67	67	traveling on a highway that is part of the national system of
68	68	interstate and defense highways or the federal aid primary highway
69	69	system.
70	70	SECTION 2. This Act takes effect immediately if it receives
71	71	a vote of two-thirds of all the members elected to each house, as
72	72	provided by Section 39, Article III, Texas Constitution. If this
73	73	Act does not receive the vote necessary for immediate effect, this
74	74	Act takes effect September 1, 2015.
