79 A BILL TO BE ENTITLED
810 AN ACT
911 relating to regulation of production of wells for retail public
1012 utilities by a groundwater conservation district.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 36.116(c), Water Code, is amended to
1315 read as follows:
14- (c) Notwithstanding Subsection (a)(2) as it relates to the
15- tract size or acreage of a well site owned by a retail public
16- utility [In regulating the production of groundwater based on tract
17- size or acreage], a district shall determine the production amount
18- for a retail public utility that provides retail water service
19- inside the district by considering [may consider] the service needs
20- or service area of the [a] retail public [water] utility. For the
21- purposes of this subsection, "retail public [water] utility" has
22- [shall have] the meaning assigned by [provided at] Section 13.002.

19+ the purposes of this subsection, "retail public [water] utility"

2324 SECTION 2. This Act takes effect September 1, 2015.
