| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 430, Transportation Code, is amended by |
|---|
| 10 | 10 | | adding Section 430.003 to read as follows: |
|---|
| 11 | 11 | | Sec. 430.003. PROCEDURES FOR REVOKING ADOPTION OF HIGHWAY |
|---|
| 12 | 12 | | SECTION. (a) In this section, "organization" includes a business |
|---|
| 13 | 13 | | entity. |
|---|
| 14 | 14 | | (b) A person may initiate the revocation of an |
|---|
| 15 | 15 | | organization's adoption of a section of the state highway system |
|---|
| 16 | 16 | | under the department's Adopt-a-Highway program or a similar |
|---|
| 17 | 17 | | department program by submitting to the department a petition |
|---|
| 18 | 18 | | signed by at least one-half of one percent of the of the total votes |
|---|
| 19 | 19 | | cast in the county, in which the highway section is located, by all |
|---|
| 20 | 20 | | candidates for governor in the most recent gubernatorial general |
|---|
| 21 | 21 | | election. |
|---|
| 22 | 22 | | (c) Not later than the 60th day after the date a petition |
|---|
| 23 | 23 | | described by Subsection (b) is received, the department shall hold |
|---|
| 24 | 24 | | a public hearing to determine whether to grant the petition to |
|---|
| 25 | 25 | | revoke the organization's adoption of the section. |
|---|
| 26 | 26 | | (d) The department shall grant the petition and revoke the |
|---|
| 27 | 27 | | organization's adoption of the section of the state highway system |
|---|
| 28 | 28 | | if the department determines that, based on the mission, history, |
|---|
| 29 | 29 | | and reputation of the organization and any other factor the |
|---|
| 30 | 30 | | department considers relevant, the adoption of the section by the |
|---|
| 31 | 31 | | organization will jeopardize the program, is counterproductive to |
|---|
| 32 | 32 | | the purpose of the program, or will create a hazard to the safety of |
|---|
| 33 | 33 | | the traveling public. |
|---|
| 34 | 34 | | SECTION 2. Section 430.003, Transportation Code, as added |
|---|
| 35 | 35 | | by this Act, applies to an organization that adopts a |
|---|
| 36 | 36 | | section of the |
|---|
| 37 | 37 | | state highway system under the Texas Department of Transportation's |
|---|
| 38 | 38 | | Adopt-a-Highway program or a similar department program before, on, |
|---|
| 39 | 39 | | or after the effective date of this Act. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2015. |
