125 relating to the authority of a venue district to act as an endorsing
136 municipality or endorsing county for purposes of games or event
147 trust funds; authorizing a fee.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subchapter E, Chapter 335, Local Government
1710 Code, is amended by adding Section 335.078 to read as follows:
1811 Sec. 335.078. VENUE DISTRICT AS ENDORSING MUNICIPALITY OR
1912 COUNTY. (a) A venue district located in a county with a population
2013 of 3.3 million or more may act as an endorsing municipality or
2114 endorsing county under Chapter 1507, Acts of the 76th Legislature,
2215 Regular Session, 1999 (Article 5190.14, Vernon's Texas Civil
2316 Statutes).
2417 (b) A venue district acting as an endorsing municipality or
2518 endorsing county under Chapter 1507, Acts of the 76th Legislature,
2619 Regular Session, 1999 (Article 5190.14, Vernon's Texas Civil
2720 Statutes), shall remit for deposit into the trust fund established
2821 for the games or event the amounts determined by the comptroller
2922 under that chapter. The comptroller shall determine the
3023 incremental increase in receipts attributable to the games or event
3124 and related activities under that chapter based on the amount of
3225 applicable taxes imposed by each municipality or county that
3326 comprises the venue district and not on the amount of taxes imposed
3427 by the venue district.
3528 (c) A venue district acting as an endorsing municipality or
3629 endorsing county under Chapter 1507, Acts of the 76th Legislature,
3730 Regular Session, 1999 (Article 5190.14, Vernon's Texas Civil
3831 Statutes), may guarantee the district's obligations under a games
3932 or event support contract by pledging surcharges from user fees,
4033 including parking or ticket fees, charged in connection with the
4134 games or event and related activities.
4235 (d) Subject to Subsection (b), a venue district acting as an
4336 endorsing municipality or endorsing county under Chapter 1507, Acts
4437 of the 76th Legislature, Regular Session, 1999 (Article 5190.14,
4538 Vernon's Texas Civil Statutes), as authorized by this section, has
4639 all the powers of an endorsing municipality or endorsing county
4740 under that chapter, and any action an endorsing municipality or
4841 endorsing county is required to take by ordinance or order under
4942 that chapter may be taken by order or resolution of the venue
5043 district.
5144 SECTION 2. This Act takes effect immediately if it receives
5245 a vote of two-thirds of all the members elected to each house, as
5346 provided by Section 39, Article III, Texas Constitution. If this
5447 Act does not receive the vote necessary for immediate effect, this
5548 Act takes effect September 1, 2015.
