137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 2175.182(a), Government Code, is amended
159 to read as follows:
1610 (a) A state agency that determines it has surplus or salvage
1711 property shall inform the commission of the property's kind,
1812 number, location, condition, original cost or value, and date of
1913 acquisition [that fact for the purpose of determining the method of
2014 disposal of the property]. The commission may take physical
2115 possession of the property.
2216 SECTION 2. The heading of Section 2175.1825, Government
2317 Code, is amended to read as follows:
2418 Sec. 2175.1825. ADVERTISING ON COMMISSION [COMPTROLLER]
2519 WEBSITE.
2620 SECTION 3. Section 2175.1825(a), Government Code, is
2721 amended to read as follows:
2822 (a) After a state agency informs the commission that it has
2923 surplus or salvage property [Not later than the second day after the
3024 date the comptroller receives notice from a state agency under
3125 Section 2175.182(c)], the commission [comptroller] shall advertise
3226 the property's kind, number, location, and condition on the
3327 commission's [comptroller's] website.
3428 SECTION 4. Section 2175.183, Government Code, is amended to
3529 read as follows:
3630 Sec. 2175.183. COMMISSION NOTICE TO OTHER ENTITIES. The
3731 commission shall inform other state agencies, political
3832 subdivisions, and assistance organizations of the commission's
3933 [comptroller's] website that lists surplus property that is
4034 available for transfer [sale].
4135 SECTION 5. The heading of Section 2175.184, Government
4236 Code, is amended to read as follows:
4337 Sec. 2175.184. [DIRECT] TRANSFER.
4438 SECTION 6. Section 2175.184(a), Government Code, is amended
4539 to read as follows:
4640 (a) During the 10 business days after the date the property
4741 is posted on the commission's [comptroller's] website, a state
4842 agency, political subdivision, or assistance organization shall
4943 coordinate with the commission for a transfer of the property at a
5044 price established by the commission. A transfer to a state agency
5145 has priority over any other transfer during this period.
5246 SECTION 7. Section 2175.185(c), Government Code, is amended
5347 to read as follows:
5448 (c) The commission [Not later than the second day after the
5549 date the comptroller receives notice under Subsection (a), the
5650 comptroller] shall remove the property from the list of surplus
5751 property for sale on the commission's [comptroller's] website on
5852 the date that the property is transferred.
5953 SECTION 8. Section 2175.190, Government Code, is amended by
6054 adding Subsection (c) to read as follows:
6155 (c) The commission by rule may establish a procedure that
6256 allows a participating state agency to receive a return on small
6357 value items through the transfer of similar items.
6458 SECTION 9. Section 2175.182(c), Government Code, is
6559 repealed.
6660 SECTION 10. The change in law made by this Act applies only
6761 to property designated by a state agency for transfer on or after
6862 the effective date of this Act. State agency property that is
6963 designated for transfer before the effective date of this Act is
7064 governed by the law in effect on the date the designation was made,
7165 and the former law is continued in effect for that purpose.
7266 SECTION 11. This Act takes effect September 1, 2015.
