11	5		relating to the transfer of surplus or salvage state agency
12	6		property.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Section 2175.182(a), Government Code, is amended
15	9		to read as follows:
16	10		(a) A state agency that determines it has surplus or salvage
17	11		property shall inform the commission of the property's kind,
18	12		number, location, condition, original cost or value, and date of
19	13		acquisition [that fact for the purpose of determining the method of
20	14		disposal of the property]. The commission may take physical
21	15		possession of the property.
22	16		SECTION 2. The heading of Section 2175.1825, Government
23	17		Code, is amended to read as follows:
24	18		Sec. 2175.1825. ADVERTISING ON COMMISSION [COMPTROLLER]
25	19		WEBSITE.
26	20		SECTION 3. Section 2175.1825(a), Government Code, is
27	21		amended to read as follows:
28	22		(a) After a state agency informs the commission that it has
29	23		surplus or salvage property [Not later than the second day after the
30	24		date the comptroller receives notice from a state agency under
31	25		Section 2175.182(c)], the commission [comptroller] shall advertise
32	26		the property's kind, number, location, and condition on the
33	27		commission's [comptroller's] website.
34	28		SECTION 4. Section 2175.183, Government Code, is amended to
35	29		read as follows:
36	30		Sec. 2175.183. COMMISSION NOTICE TO OTHER ENTITIES. The
37	31		commission shall inform other state agencies, political
38	32		subdivisions, and assistance organizations of the commission's
39	33		[comptroller's] website that lists surplus property that is
40	34		available for transfer [sale].
41	35		SECTION 5. The heading of Section 2175.184, Government
42	36		Code, is amended to read as follows:
43	37		Sec. 2175.184. [DIRECT] TRANSFER.
44	38		SECTION 6. Section 2175.184(a), Government Code, is amended
45	39		to read as follows:
46	40		(a) During the 10 business days after the date the property
47	41		is posted on the commission's [comptroller's] website, a state
48	42		agency, political subdivision, or assistance organization shall
49	43		coordinate with the commission for a transfer of the property at a
50	44		price established by the commission. A transfer to a state agency
51	45		has priority over any other transfer during this period.
52	46		SECTION 7. Section 2175.185(c), Government Code, is amended
53	47		to read as follows:
54	48		(c) The commission [Not later than the second day after the
55	49		date the comptroller receives notice under Subsection (a), the
56	50		comptroller] shall remove the property from the list of surplus
57	51		property for sale on the commission's [comptroller's] website on
58	52		the date that the property is transferred.
59	53		SECTION 8. Section 2175.190, Government Code, is amended by
60	54		adding Subsection (c) to read as follows:
61	55		(c) The commission by rule may establish a procedure that
62	56		allows a participating state agency to receive a return on small
63	57		value items through the transfer of similar items.
64	58		SECTION 9. Section 2175.182(c), Government Code, is
65	59		repealed.
66	60		SECTION 10. The change in law made by this Act applies only
67	61		to property designated by a state agency for transfer on or after
68	62		the effective date of this Act. State agency property that is
69	63		designated for transfer before the effective date of this Act is
70	64		governed by the law in effect on the date the designation was made,
71	65		and the former law is continued in effect for that purpose.
72	66		SECTION 11. This Act takes effect September 1, 2015.
