55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the date of the election for trustees of an independent
88 school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.0581(a), Education Code, is amended
1111 to read as follows:
1212 (a) An election for trustees of an independent school
1313 district shall be held on the same date as[:
1414 [(1) the election for the members of the governing body
1515 of a municipality located in the school district;
1616 [(2)] the general election for state and county
1717 officers or the date of the general primary election[;
1818 [(3) the election for the members of the governing body
1919 of a hospital district, if the school district:
2020 [(A) is wholly or partly located in a county with
2121 a population of less than 40,000 that is adjacent to a county with a
2222 population of more than three million; and
2323 [(B) held its election for trustees jointly with
2424 the election for the members of the governing body of the hospital
2525 district before May 2007; or
2626 [(4) the election for the members of the governing
2727 board of a public junior college district in which the school
2828 district is wholly or partly located].
2929 SECTION 2. Sections 11.059(a) and (e), Education Code, are
3030 amended to read as follows:
3131 (a) A trustee of an independent school district serves a
3232 term of [three or] four years.
3333 (e) Not later than December 31, 2015 [2011], the board of
3434 trustees may adopt a resolution changing the length of the terms of
3535 its trustees. The resolution must provide for staggered terms of
3636 [either three or] four years and specify the manner in which the
3737 transition from the length of the former term to the modified term
3838 is made. The transition must begin with the first regular election
3939 for trustees that occurs after January 1, 2016 [2012], and a trustee
4040 who serves on that date shall serve the remainder of that
4141 term. This subsection expires January 1, 2021 [2017].
4242 SECTION 3. The heading to Section 41.0052, Election Code,
4343 is amended to read as follows:
4444 Sec. 41.0052. [CHANGING] GENERAL ELECTION DATE OF POLITICAL
4545 SUBDIVISION OTHER THAN COUNTY.
4646 SECTION 4. Sections 41.0052(a) and (e), Election Code, are
4747 amended to read as follows:
4848 (a) The governing body of a political subdivision, other
4949 than a county, that holds its general election for officers on a
5050 date other than the November uniform election date or the date of
5151 the general primary election shall [may], not later than December
5252 31, 2016 [2012], change the date on which it holds its general
5353 election for officers to the November uniform election date or the
5454 date of the general primary election.
5555 (e) The governing body of a newly incorporated city may, not
5656 later than the second anniversary of the date of incorporation,
5757 change the date on which it holds its general election for officers
5858 to another authorized [uniform] election date.
5959 SECTION 5. Section 11.059(b), Education Code, and Section
6060 41.005, Election Code, are repealed.
6161 SECTION 6. This Act takes effect September 1, 2015.
