6	6	AN ACT
7	7	relating to the date of the election for trustees of an independent
8	8	school district.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 11.0581(a), Education Code, is amended
11	11	to read as follows:
12	12	(a) An election for trustees of an independent school
13	13	district shall be held on the same date as[:
14	14	[(1) the election for the members of the governing body
15	15	of a municipality located in the school district;
16	16	[(2)] the general election for state and county
17	17	officers or the date of the general primary election[;
18	18	[(3) the election for the members of the governing body
19	19	of a hospital district, if the school district:
20	20	[(A) is wholly or partly located in a county with
21	21	a population of less than 40,000 that is adjacent to a county with a
22	22	population of more than three million; and
23	23	[(B) held its election for trustees jointly with
24	24	the election for the members of the governing body of the hospital
25	25	district before May 2007; or
26	26	[(4) the election for the members of the governing
27	27	board of a public junior college district in which the school
28	28	district is wholly or partly located].
29	29	SECTION 2. Sections 11.059(a) and (e), Education Code, are
30	30	amended to read as follows:
31	31	(a) A trustee of an independent school district serves a
32	32	term of [three or] four years.
33	33	(e) Not later than December 31, 2015 [2011], the board of
34	34	trustees may adopt a resolution changing the length of the terms of
35	35	its trustees. The resolution must provide for staggered terms of
36	36	[either three or] four years and specify the manner in which the
37	37	transition from the length of the former term to the modified term
38	38	is made. The transition must begin with the first regular election
39	39	for trustees that occurs after January 1, 2016 [2012], and a trustee
40	40	who serves on that date shall serve the remainder of that
41	41	term. This subsection expires January 1, 2021 [2017].
42	42	SECTION 3. The heading to Section 41.0052, Election Code,
43	43	is amended to read as follows:
44	44	Sec. 41.0052. [CHANGING] GENERAL ELECTION DATE OF POLITICAL
45	45	SUBDIVISION OTHER THAN COUNTY.
46	46	SECTION 4. Sections 41.0052(a) and (e), Election Code, are
47	47	amended to read as follows:
48	48	(a) The governing body of a political subdivision, other
49	49	than a county, that holds its general election for officers on a
50	50	date other than the November uniform election date or the date of
51	51	the general primary election shall [may], not later than December
52	52	31, 2016 [2012], change the date on which it holds its general
53	53	election for officers to the November uniform election date or the
54	54	date of the general primary election.
55	55	(e) The governing body of a newly incorporated city may, not
56	56	later than the second anniversary of the date of incorporation,
57	57	change the date on which it holds its general election for officers
58	58	to another authorized [uniform] election date.
59	59	SECTION 5. Section 11.059(b), Education Code, and Section
60	60	41.005, Election Code, are repealed.
61	61	SECTION 6. This Act takes effect September 1, 2015.
