214 AN ACT
225 relating to requirements governing registration and authorized
236 activities of certain lobbyists; expanding the applicability of an
247 occupational registration.
258 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
269 SECTION 1. Section 305.0041(a), Government Code, is amended
2710 to read as follows:
2811 (a) A person is not required to register under this chapter
2912 in accordance with Section 305.003(a)(2) solely because the person
3013 receives or is entitled to receive compensation or reimbursement
3114 to:
3215 (1) communicate as an employee of a vendor of a product
3316 or service to a member of the executive branch concerning state
3417 agency purchasing decisions that do not exceed 10 million dollars
3518 involving a product, service, or service provider or negotiations
3619 regarding such decisions;
3720 (2) communicate as an employee of a vendor of a product
3821 or service to a member of the executive branch concerning state
3922 agency purchasing decisions that exceed 10 million dollars
4023 involving a product, service, or service provider or negotiations
4124 regarding such decisions if the compensation for the communication
4225 is not totally or partially contingent on the outcome of any
4326 administrative action;
4427 (3) [communicate in a capacity other than as an
4528 employee of a vendor of a product or service to a member of the
4629 executive branch concerning state agency purchasing decisions
4730 involving a product, service, or service provider or negotiations
4831 regarding such decisions if the compensation for the communication
4932 is not totally or partially contingent on the outcome of any
5033 administrative action;
5134 [(4)] communicate as a member of an advisory committee
5235 or task force if the person is appointed to serve in that capacity
5336 by a member of the legislative or executive branch; or
5437 (4) [(5)] communicate as a member of a board, task
5538 force, or advisory committee on which a member of the legislative or
5639 executive branch also serves.
5740 SECTION 2. Sections 305.022(c-1) and (c-3), Government
5841 Code, are repealed.
5942 SECTION 3. A person who is required to register under
6043 Chapter 305, Government Code, solely as a result of the change in
6144 law made by this Act to Section 305.0041(a), Government Code, is not
6245 required to register under that chapter before January 1, 2016.
6346 SECTION 4. This Act takes effect September 1, 2015.
