The bill would amend the Code of Criminal Procedure to limit the amount to be repaid by a defendant to a county to the actual cost of the legal services provided to a defendant with appointed counsel, would clarify the appropriate amount for attorney fee repayment orders in those cases where the defendant is represented by a public defender's office, and would require attorney fee repayment orders issued as a condition of community supervision be subject to an "ability to pay" finding by the requirement as exists when they are ordered as court costs. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
