15 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 10 | | SECTION 1. Section 1(2), Article 18.21, Code of Criminal |
---|
17 | 11 | | Procedure, is amended to read as follows: |
---|
18 | 12 | | (2) "Authorized peace officer" means: |
---|
19 | 13 | | (A) a sheriff or a sheriff's deputy; |
---|
20 | 14 | | (B) a constable or deputy constable; |
---|
21 | 15 | | (C) a marshal or police officer of an |
---|
22 | 16 | | incorporated city; |
---|
23 | 17 | | (D) a ranger or officer commissioned by the |
---|
24 | 18 | | Public Safety Commission or the director of the Department of |
---|
25 | 19 | | Public Safety; |
---|
26 | 20 | | (E) an investigator of a prosecutor's office; |
---|
27 | 21 | | (F) a law enforcement agent of the Alcoholic |
---|
28 | 22 | | Beverage Commission; |
---|
29 | 23 | | (G) a law enforcement officer commissioned by the |
---|
30 | 24 | | Parks and Wildlife Commission; |
---|
31 | 25 | | (H) an enforcement officer appointed by the |
---|
32 | 26 | | inspector general of the Texas Department of Criminal Justice under |
---|
33 | 27 | | Section 493.019, Government Code; [or] |
---|
34 | 28 | | (I) an investigator commissioned by the attorney |
---|
35 | 29 | | general under Section 402.009, Government Code; or |
---|
36 | 30 | | (J) a member of an arson investigating unit |
---|
37 | 31 | | commissioned by a municipality, a county, or the state. |
---|
38 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
39 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
40 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
41 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
42 | 36 | | Act takes effect September 1, 2015. |
