126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Section 2157.007, Government Code, is amended to
148 read as follows:
159 Sec. 2157.007. CONSIDERATION OF CLOUD [ADVANCED
1610 INTERNET-BASED] COMPUTING SERVICE PURCHASE. (a) "Cloud [Advanced
1711 Internet-based] computing service" has the meaning assigned by
1812 Special Publication 800-145 issued by the United States Department
1913 of Commerce National Institute of Standards and Technology, as the
2014 definition existed on January 1, 2015 [means a service that
2115 provides network access to a shared pool of configurable computing
2216 resources on demand, including networks, servers, storage,
2317 applications, or related technology services, that may be rapidly
2418 provisioned and released by the service provider with minimal
2519 effort and interaction. The term does not include
2620 telecommunications service or the act of hosting computing
2721 resources dedicated to a single purchaser].
2822 (b) A state agency may consider cloud [advanced
2923 Internet-based] computing service options, including any cost
3024 associated with purchasing those service options, when making
3125 purchases for a major information resources project under Section
3226 2054.118.
3327 (c) A state agency shall ensure that information resources
3428 projects that use cloud [advanced Internet-based] computing
3529 service options meet or exceed required state standards for
3630 cybersecurity.
3731 (d) Using existing resources, the department may review the
3832 process for the coordinated development, hosting, and management of
3933 computer software for state agencies that use cloud [advanced
4034 Internet-based] computing services.
4135 SECTION 2. This Act takes effect September 1, 2015.
