| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 39, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 39.0533 to read as follows: |
|---|
| 13 | 13 | | Sec. 39.0533. RESULTS OF ASSESSMENT INSTRUMENTS FOR |
|---|
| 14 | 14 | | OUT-OF-STATE TRANSFER STUDENTS NOT CONSIDERED FOR CERTAIN |
|---|
| 15 | 15 | | PURPOSES. (a) This section applies only to a student who transfers |
|---|
| 16 | 16 | | from a school in another state to a school district in this state. |
|---|
| 17 | 17 | | (b) For assessment instruments required to be administered |
|---|
| 18 | 18 | | under Section 39.023, the results of those assessment instruments |
|---|
| 19 | 19 | | administered to a student subject to this section may not be used |
|---|
| 20 | 20 | | for the first school year in which the student is enrolled in a |
|---|
| 21 | 21 | | school district in this state for purposes of: |
|---|
| 22 | 22 | | (1) the appraisal process for teachers under Chapter |
|---|
| 23 | 23 | | 21; or |
|---|
| 24 | 24 | | (2) the determination of accreditation status for |
|---|
| 25 | 25 | | school districts or performance ratings or distinction |
|---|
| 26 | 26 | | designations for school districts or campuses under this chapter. |
|---|
| 27 | 27 | | SECTION 2. This Act applies beginning with the 2015-2016 |
|---|
| 28 | 28 | | school year. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2015. |
