A BILL TO BE ENTITLED
AN ACT
relating to the use of the results of assessment instruments
administered to public school students transferring from
out-of-state schools.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 39, Education Code, is
amended by adding Section 39.0533 to read as follows:
Sec. 39.0533. RESULTS OF ASSESSMENT INSTRUMENTS FOR
OUT-OF-STATE TRANSFER STUDENTS NOT CONSIDERED FOR CERTAIN
PURPOSES. (a) This section applies only to a student who transfers
from a school in another state to a school district in this state.
(b) For assessment instruments required to be administered
under Section 39.023, the results of those assessment instruments
administered to a student subject to this section may not be used
for the first school year in which the student is enrolled in a
school district in this state for purposes of:
(1) the appraisal process for teachers under Chapter
21; or
(2) the determination of accreditation status for
school districts or performance ratings or distinction
designations for school districts or campuses under this chapter.
SECTION 2. This Act applies beginning with the 2015-2016
school year.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
