66 AN ACT
77 relating to training on, issuance of, and use of limited term
88 driver's licenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.111(c), Election Code, is amended to
1111 read as follows:
1212 (c) The training standards adopted under Subsection (a)
1313 must:
1414 (1) include provisions on the acceptance and handling
1515 of the identification presented by a voter to an election officer
1616 under Section 63.001; and
1717 (2) detail the types of driver's licenses that are
1818 acceptable forms of identification under Section 63.0101 and
1919 require that training materials include a photograph of a limited
2020 term license issued under Subchapter L-1, Chapter 521,
2121 Transportation Code.
2222 SECTION 2. Chapter 521, Transportation Code, is amended by
2323 adding Subchapter L-1 to read as follows:
2424 SUBCHAPTER L-1. LIMITED TERM LICENSE
2525 Sec. 521.261. LIMITED TERM LICENSE. (a) A limited term
2626 license is a driver's license issued by the department with an
2727 expiration date set under Section 521.271(a-2), (a-3), or (a-4),
2828 521.2711(c), or 521.272(c)(2), Transportation Code.
2929 (b) Each limited term license must comply with the
3030 requirements of this subchapter.
3131 (c) Except as otherwise provided by this subchapter, a
3232 reference in this subchapter to a limited term license includes a
3333 limited term instruction permit.
3434 Sec. 521.262. APPLICABILITY OF OTHER LAW. (a) A limited
3535 term license:
3636 (1) is not valid as proof of the license holder's
3737 identity for a federal purpose;
3838 (2) is not an acceptable form of identification under
3939 Section 63.0101, Election Code, for voting purposes; and
4040 (3) expires in the manner provided by Subchapter M.
4141 (b) Except as otherwise provided by this chapter:
4242 (1) a person who holds a limited term license is
4343 subject to the laws of this state applicable to the holder of a
4444 driver's license;
4545 (2) a person who holds a limited term provisional
4646 license or instruction permit is subject to the laws of this state
4747 applicable to a holder of a provisional license or instruction
4848 permit; and
4949 (3) a person who holds a limited term occupational
5050 license is subject to the laws of this state applicable to the
5151 holder of an occupational license.
5252 Sec. 521.263. LIMITED TERM LICENSE APPEARANCE. The
5353 department shall:
5454 (1) adopt rules regarding the design and content of a
5555 limited term license;
5656 (2) designate and clearly mark as a limited term
5757 license a license described by Section 521.261(a);
5858 (3) orient the information on and design the color of a
5959 limited term license to clearly distinguish the limited term
6060 license from other licenses issued under this chapter; and
6161 (4) include on a limited term license an indication
6262 that the license is not valid proof of identity for a federal
6363 purpose or for voting purposes.
6464 Sec. 521.264. APPLICATION. (a) The department may require
6565 each applicant for a limited term license to furnish to the
6666 department the information required by Section 521.142.
6767 (b) An application for a limited term license:
6868 (1) must include a complete set of thumbprints and
6969 fingerprints; and
7070 (2) must include documentation issued by the
7171 appropriate United States agency that authorizes the applicant to
7272 be in the United States but may not use as proof of the applicant's
7373 residency status or lawful status:
7474 (A) an employment authorization document issued
7575 through the federal Deferred Action for Childhood Arrivals program;
7676 or
7777 (B) a reentry permit.
7878 (c) Information supplied to the department relating to an
7979 applicant's medical history is for the confidential use of the
8080 department and may not be disclosed to any person or used as
8181 evidence in a legal proceeding other than a proceeding under
8282 Subchapter N.
8383 (d) The application must provide space for the applicant to
8484 voluntarily list any health condition that may impede communication
8585 with a peace officer as evidenced by a written statement from a
8686 licensed physician.
8787 Sec. 521.265. EVIDENCE OF FINANCIAL RESPONSIBILITY
8888 REQUIRED. (a) An application for a limited term license must be
8989 accompanied by:
9090 (1) evidence of financial responsibility that
9191 complies with Section 521.143 and this section; or
9292 (2) a statement that the applicant does not own a motor
9393 vehicle for which evidence of financial responsibility is required
9494 under Chapter 601.
9595 (b) An applicant for a limited term license that provides
9696 evidence of financial responsibility must establish financial
9797 responsibility through a motor vehicle liability insurance policy
9898 that complies with Chapter 601 and is prepaid and valid for at least
9999 a six-month period after the date the person submits the
100100 application.
101101 Sec. 521.266. ADMINISTRATION. The department is not
102102 required to issue limited term licenses at all driver's license
103103 offices. The department may designate driver's license offices to
104104 issue limited term licenses.
105105 SECTION 3. This Act takes effect September 1, 2015.
