6	6	AN ACT
7	7	relating to training on, issuance of, and use of limited term
8	8	driver's licenses.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 32.111(c), Election Code, is amended to
11	11	read as follows:
12	12	(c) The training standards adopted under Subsection (a)
13	13	must:
14	14	(1) include provisions on the acceptance and handling
15	15	of the identification presented by a voter to an election officer
16	16	under Section 63.001; and
17	17	(2) detail the types of driver's licenses that are
18	18	acceptable forms of identification under Section 63.0101 and
19	19	require that training materials include a photograph of a limited
20	20	term license issued under Subchapter L-1, Chapter 521,
21	21	Transportation Code.
22	22	SECTION 2. Chapter 521, Transportation Code, is amended by
23	23	adding Subchapter L-1 to read as follows:
24	24	SUBCHAPTER L-1. LIMITED TERM LICENSE
25	25	Sec. 521.261. LIMITED TERM LICENSE. (a) A limited term
26	26	license is a driver's license issued by the department with an
27	27	expiration date set under Section 521.271(a-2), (a-3), or (a-4),
28	28	521.2711(c), or 521.272(c)(2), Transportation Code.
29	29	(b) Each limited term license must comply with the
30	30	requirements of this subchapter.
31	31	(c) Except as otherwise provided by this subchapter, a
32	32	reference in this subchapter to a limited term license includes a
33	33	limited term instruction permit.
34	34	Sec. 521.262. APPLICABILITY OF OTHER LAW. (a) A limited
35	35	term license:
36	36	(1) is not valid as proof of the license holder's
37	37	identity for a federal purpose;
38	38	(2) is not an acceptable form of identification under
39	39	Section 63.0101, Election Code, for voting purposes; and
40	40	(3) expires in the manner provided by Subchapter M.
41	41	(b) Except as otherwise provided by this chapter:
42	42	(1) a person who holds a limited term license is
43	43	subject to the laws of this state applicable to the holder of a
44	44	driver's license;
45	45	(2) a person who holds a limited term provisional
46	46	license or instruction permit is subject to the laws of this state
47	47	applicable to a holder of a provisional license or instruction
48	48	permit; and
49	49	(3) a person who holds a limited term occupational
50	50	license is subject to the laws of this state applicable to the
51	51	holder of an occupational license.
52	52	Sec. 521.263. LIMITED TERM LICENSE APPEARANCE. The
53	53	department shall:
54	54	(1) adopt rules regarding the design and content of a
55	55	limited term license;
56	56	(2) designate and clearly mark as a limited term
57	57	license a license described by Section 521.261(a);
58	58	(3) orient the information on and design the color of a
59	59	limited term license to clearly distinguish the limited term
60	60	license from other licenses issued under this chapter; and
61	61	(4) include on a limited term license an indication
62	62	that the license is not valid proof of identity for a federal
63	63	purpose or for voting purposes.
64	64	Sec. 521.264. APPLICATION. (a) The department may require
65	65	each applicant for a limited term license to furnish to the
66	66	department the information required by Section 521.142.
67	67	(b) An application for a limited term license:
68	68	(1) must include a complete set of thumbprints and
69	69	fingerprints; and
70	70	(2) must include documentation issued by the
71	71	appropriate United States agency that authorizes the applicant to
72	72	be in the United States but may not use as proof of the applicant's
73	73	residency status or lawful status:
74	74	(A) an employment authorization document issued
75	75	through the federal Deferred Action for Childhood Arrivals program;
76	76	or
77	77	(B) a reentry permit.
78	78	(c) Information supplied to the department relating to an
79	79	applicant's medical history is for the confidential use of the
80	80	department and may not be disclosed to any person or used as
81	81	evidence in a legal proceeding other than a proceeding under
82	82	Subchapter N.
83	83	(d) The application must provide space for the applicant to
84	84	voluntarily list any health condition that may impede communication
85	85	with a peace officer as evidenced by a written statement from a
86	86	licensed physician.
87	87	Sec. 521.265. EVIDENCE OF FINANCIAL RESPONSIBILITY
88	88	REQUIRED. (a) An application for a limited term license must be
89	89	accompanied by:
90	90	(1) evidence of financial responsibility that
91	91	complies with Section 521.143 and this section; or
92	92	(2) a statement that the applicant does not own a motor
93	93	vehicle for which evidence of financial responsibility is required
94	94	under Chapter 601.
95	95	(b) An applicant for a limited term license that provides
96	96	evidence of financial responsibility must establish financial
97	97	responsibility through a motor vehicle liability insurance policy
98	98	that complies with Chapter 601 and is prepaid and valid for at least
99	99	a six-month period after the date the person submits the
100	100	application.
101	101	Sec. 521.266. ADMINISTRATION. The department is not
102	102	required to issue limited term licenses at all driver's license
103	103	offices. The department may designate driver's license offices to
104	104	issue limited term licenses.
105	105	SECTION 3. This Act takes effect September 1, 2015.
