84R12607 JXC-D By: Dale H.B. No. 3840 A BILL TO BE ENTITLED AN ACT relating to training on, issuance of, and use of limited term driver's licenses. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 32.111(c), Election Code, is amended to read as follows: (c) The training standards adopted under Subsection (a) must: (1) include provisions on the acceptance and handling of the identification presented by a voter to an election officer under Section 63.001; and (2) detail the types of driver's licenses that are acceptable forms of identification under Section 63.0101 and require that training materials include a photograph of a limited term license issued under Subchapter L-1, Chapter 521, Transportation Code. SECTION 2. Chapter 521, Transportation Code, is amended by adding Subchapter L-1 to read as follows: SUBCHAPTER L-1. LIMITED TERM LICENSE Sec. 521.261. LIMITED TERM LICENSE. (a) A limited term license is a driver's license issued by the department with an expiration date set under Section 521.271(a-2), (a-3), or (a-4), 521.2711(c), or 521.272(c)(2), Transportation Code. (b) Each limited term license must comply with the requirements of this subchapter. (c) Except as otherwise provided by this subchapter, a reference in this subchapter to a limited term license includes a limited term instruction permit. Sec. 521.262. APPLICABILITY OF OTHER LAW. (a) A limited term license: (1) is not valid as proof of the license holder's identity for a federal purpose; (2) is not an acceptable form of identification under Section 63.0101, Election Code, for voting purposes; and (3) expires in the manner provided by Subchapter M. (b) Except as otherwise provided by this chapter: (1) a person who holds a limited term license is subject to the laws of this state applicable to the holder of a driver's license; (2) a person who holds a limited term provisional license or instruction permit is subject to the laws of this state applicable to a holder of a provisional license or instruction permit; and (3) a person who holds a limited term occupational license is subject to the laws of this state applicable to the holder of an occupational license. Sec. 521.263. LIMITED TERM LICENSE APPEARANCE. The department shall: (1) adopt rules regarding the design and content of a limited term license; (2) designate and clearly mark as a limited term license a license described by Section 521.261(a); (3) orient the information on and design the color of a limited term license to clearly distinguish the limited term license from other licenses issued under this chapter; and (4) include on a limited term license an indication that the license is not valid proof of identity for a federal purpose or for voting purposes. Sec. 521.264. APPLICATION. (a) The department may require each applicant for a limited term license to furnish to the department the information required by Section 521.142. (b) An application for a limited term license: (1) must include a complete set of thumbprints and fingerprints; and (2) must include documentation issued by the appropriate United States agency that authorizes the applicant to be in the United States but may not use as proof of the applicant's residency status or lawful status: (A) an employment authorization document issued through the federal Deferred Action for Childhood Arrivals program; or (B) a reentry permit. (c) Information supplied to the department relating to an applicant's medical history is for the confidential use of the department and may not be disclosed to any person or used as evidence in a legal proceeding other than a proceeding under Subchapter N. (d) The application must provide space for the applicant to voluntarily list any health condition that may impede communication with a peace officer as evidenced by a written statement from a licensed physician. Sec. 521.265. EVIDENCE OF FINANCIAL RESPONSIBILITY REQUIRED. (a) An application for a limited term license must be accompanied by: (1) evidence of financial responsibility that complies with Section 521.143 and this section; or (2) a statement that the applicant does not own a motor vehicle for which evidence of financial responsibility is required under Chapter 601. (b) An applicant for a limited term license that provides evidence of financial responsibility must establish financial responsibility through a motor vehicle liability insurance policy that complies with Chapter 601 and is prepaid and valid for at least a six-month period after the date the person submits the application. Sec. 521.266. ADMINISTRATION. The department is not required to issue limited term licenses at all driver's license offices. The department may designate driver's license offices to issue limited term licenses. SECTION 3. This Act takes effect September 1, 2015.
