| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.054, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (a-2) to read as follows: |
|---|
| 12 | 12 | | (a-2) The commissioner, in evaluating school district or |
|---|
| 13 | 13 | | campus performance, may not assign a district or campus a rating |
|---|
| 14 | 14 | | under Subsection (a) if data quality or integrity is compromised. |
|---|
| 15 | 15 | | The commissioner must designate the district or campus as "Not |
|---|
| 16 | 16 | | rated: Data integrity issues." |
|---|
| 17 | 17 | | SECTION 2. Section 39.151(c), Education Code, is amended to |
|---|
| 18 | 18 | | read as follows: |
|---|
| 19 | 19 | | (c) A [The commissioner may limit a challenge under this |
|---|
| 20 | 20 | | section to a written submission of any issue identified by the] |
|---|
| 21 | 21 | | school district or open-enrollment charter school is entitled to |
|---|
| 22 | 22 | | appear before the committee relating to a challenge under this |
|---|
| 23 | 23 | | section [challenging the agency decision]. |
|---|
| 24 | 24 | | SECTION 3. This Act applies beginning with the 2015-2016 |
|---|
| 25 | 25 | | school year. |
|---|
| 26 | 26 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2015. |
|---|
