77 relating to the use of fireworks at certain Texas Department of
88 Transportation rest areas; providing a penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter F, Chapter 203,
1111 Transportation Code, is amended to read as follows:
1212 SUBCHAPTER F. USE [LEASE] OF CERTAIN PROPERTY
1313 SECTION 2. Subchapter F, Chapter 203, Transportation Code,
1414 is amended by adding Section 203.112 to read as follows:
1515 Sec. 203.112. PROHIBITION OR RESTRICTION OF FIREWORKS AT
1616 REST AREA. (a) In this section, "rest area" means public real
1717 property designated as a rest area, comfort station, picnic area,
1818 roadside park, or scenic overlook by the department.
1919 (b) The commission by order shall prohibit or restrict the
2020 use of fireworks at a state highway rest area in the unincorporated
2121 area of a county on the petition of the commissioners court of the
2222 county.
2323 (c) An order adopted under Subsection (b) must require the
2424 county to erect signs at the rest area giving notice of the order.
2525 (d) A person who knowingly or intentionally violates a
2626 prohibition or restriction established by an order adopted under
2727 this section commits an offense. An offense under this subsection
2828 is a Class C misdemeanor.
2929 SECTION 3. This Act takes effect September 1, 2015.
