55 AN ACT
66 relating to the Texas enterprise fund.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 481.078, Government Code is amended by
99 adding Subsection (m) as follows:
1010 (m) In a calendar year at least 35 percent of the grant
1111 agreements entered into must contain a provision that requires all
1212 of the jobs created under the agreement to be created:
1313 (1) in an area designated as a Qualified Census Tract
1414 (QCTs) as defined by the U.S. Department of Housing and Urban
1515 Development (HUD); and
1616 (2) target and promote appropriate size companies of
1717 approximately 25 employees or more.
1818 SECTION 2. Section 481.079, Government Code is amended as
1919 follows:
2020 Sec. 481.079. REPORT ON USE OF MONEY IN TEXAS ENTERPRISE
2121 FUND. (a) Before the beginning of each regular session of the
2222 legislature, the governor shall submit to the lieutenant governor,
2323 the speaker of the house of representatives, and each other member
2424 of the legislature a report on grants made under Section 481.078
2525 that states:
2626 (1) the number of direct jobs each recipient committed
2727 to create in this state, regional and under Section 481.078 (m);
2828 (2) the number of direct jobs each recipient created
2929 in this state, regional and under Section 481.078 (m);
3030 (3) the median wage of the jobs each recipient created
3131 in this state, regional and under Section 481.078 (m);
3232 (4) measures the typical lifespan of the jobs each
3333 recipient created;
3434 (5) whether the jobs created each recipient created
3535 are generally aligned with the skill levels of the residents in the
3636 area where the jobs are created
3737 (4) (6) the amount of capital investment each
3838 recipient committed to expend or allocate per project in this
3939 state, regional and under Section 481.078 (m);
4040 (5) (7) the amount of capital investment each
4141 recipient expended or allocated per project in this state, regional
4242 and under Section 481.078 (m);
4343 (6) (8) the total amount of grants made to each
4444 recipient;
4545 (7) (9) the average amount of money granted in this
4646 state for each job created in this state, regional and under
4747 Section 481.078 (m)
4848 by grant recipients;
4949 (8) (10) the number of jobs created in this state by
5050 grant recipients in each sector of the North American Industry
5151 Classification System (NAICS); and
5252 (9) (11) of the number of direct jobs each recipient
5353 created in this state, regional and under Section 481.078 (m), the
5454 number of positions created that provide health benefits for
5555 employees.
5656 (a-1) For grants awarded for a purpose specified by Section
5757 481.078(d-1), the report must include only the amount and purpose
5858 of each grant.
5959 (b) The report may not include information that is made
6060 confidential by law.
6161 (c) The governor may require a recipient of a grant under
6262 Section 481.078 to submit, on a form the governor provides,
6363 information required to complete the report
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2015.
