| 6 | 6 | | relating to the Texas enterprise fund. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 481.078, Government Code is amended by |
|---|
| 9 | 9 | | adding Subsection (m) as follows: |
|---|
| 10 | 10 | | (m) In a calendar year at least 35 percent of the grant |
|---|
| 11 | 11 | | agreements entered into must contain a provision that requires all |
|---|
| 12 | 12 | | of the jobs created under the agreement to be created: |
|---|
| 13 | 13 | | (1) in an area designated as a Qualified Census Tract |
|---|
| 14 | 14 | | (QCTs) as defined by the U.S. Department of Housing and Urban |
|---|
| 15 | 15 | | Development (HUD); and |
|---|
| 16 | 16 | | (2) target and promote appropriate size companies of |
|---|
| 17 | 17 | | approximately 25 employees or more. |
|---|
| 18 | 18 | | SECTION 2. Section 481.079, Government Code is amended as |
|---|
| 19 | 19 | | follows: |
|---|
| 20 | 20 | | Sec. 481.079. REPORT ON USE OF MONEY IN TEXAS ENTERPRISE |
|---|
| 21 | 21 | | FUND. (a) Before the beginning of each regular session of the |
|---|
| 22 | 22 | | legislature, the governor shall submit to the lieutenant governor, |
|---|
| 23 | 23 | | the speaker of the house of representatives, and each other member |
|---|
| 24 | 24 | | of the legislature a report on grants made under Section 481.078 |
|---|
| 25 | 25 | | that states: |
|---|
| 26 | 26 | | (1) the number of direct jobs each recipient committed |
|---|
| 27 | 27 | | to create in this state, regional and under Section 481.078 (m); |
|---|
| 28 | 28 | | (2) the number of direct jobs each recipient created |
|---|
| 29 | 29 | | in this state, regional and under Section 481.078 (m); |
|---|
| 30 | 30 | | (3) the median wage of the jobs each recipient created |
|---|
| 31 | 31 | | in this state, regional and under Section 481.078 (m); |
|---|
| 32 | 32 | | (4) measures the typical lifespan of the jobs each |
|---|
| 33 | 33 | | recipient created; |
|---|
| 34 | 34 | | (5) whether the jobs created each recipient created |
|---|
| 35 | 35 | | are generally aligned with the skill levels of the residents in the |
|---|
| 36 | 36 | | area where the jobs are created |
|---|
| 37 | 37 | | (4) (6) the amount of capital investment each |
|---|
| 38 | 38 | | recipient committed to expend or allocate per project in this |
|---|
| 39 | 39 | | state, regional and under Section 481.078 (m); |
|---|
| 40 | 40 | | (5) (7) the amount of capital investment each |
|---|
| 41 | 41 | | recipient expended or allocated per project in this state, regional |
|---|
| 42 | 42 | | and under Section 481.078 (m); |
|---|
| 43 | 43 | | (6) (8) the total amount of grants made to each |
|---|
| 44 | 44 | | recipient; |
|---|
| 45 | 45 | | (7) (9) the average amount of money granted in this |
|---|
| 46 | 46 | | state for each job created in this state, regional and under |
|---|
| 47 | 47 | | Section 481.078 (m) |
|---|
| 48 | 48 | | by grant recipients; |
|---|
| 49 | 49 | | (8) (10) the number of jobs created in this state by |
|---|
| 50 | 50 | | grant recipients in each sector of the North American Industry |
|---|
| 51 | 51 | | Classification System (NAICS); and |
|---|
| 52 | 52 | | (9) (11) of the number of direct jobs each recipient |
|---|
| 53 | 53 | | created in this state, regional and under Section 481.078 (m), the |
|---|
| 54 | 54 | | number of positions created that provide health benefits for |
|---|
| 55 | 55 | | employees. |
|---|
| 56 | 56 | | (a-1) For grants awarded for a purpose specified by Section |
|---|
| 57 | 57 | | 481.078(d-1), the report must include only the amount and purpose |
|---|
| 58 | 58 | | of each grant. |
|---|
| 59 | 59 | | (b) The report may not include information that is made |
|---|
| 60 | 60 | | confidential by law. |
|---|
| 61 | 61 | | (c) The governor may require a recipient of a grant under |
|---|
| 62 | 62 | | Section 481.078 to submit, on a form the governor provides, |
|---|
| 63 | 63 | | information required to complete the report |
|---|
| 64 | 64 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 68 | 68 | | Act takes effect September 1, 2015. |
