115 relating to the qualifications and method of electing directors of
126 the Jonah Water Special Utility District.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subtitle C, Title 6, Special District Local Laws
159 Code, is amended by adding Chapter 7218 to read as follows:
1610 CHAPTER 7218. JONAH WATER SPECIAL UTILITY DISTRICT
1711 SUBCHAPTER A. GENERAL PROVISIONS
1812 Sec. 7218.001. DEFINITIONS. In this chapter:
1913 (1) "Board" means the board of directors of the
2014 district.
2115 (2) "Director" means a member of the board.
2216 (3) "District" means the Jonah Water Special Utility
2317 District.
2418 SUBCHAPTER B. BOARD OF DIRECTORS
2519 Sec. 7218.051. COMPOSITION OF BOARD. The district is
2620 governed by a board of nine directors.
2721 Sec. 7218.052. DIRECTOR ELIGIBILITY. To be eligible to be
2822 listed on the ballot as a candidate for or to serve as a director, a
2923 person must be:
3024 (1) a resident of the district; and
3125 (2) a retail water or sewer service customer of the
3226 district.
3327 Sec. 7218.053. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
3428 DISTRICTS. (a) The board by rule may provide for the election of
3529 some or all of the directors from single-member districts.
3630 (b) In addition to the qualifications required by Section
3731 7218.052, if the board provides for the election of some or all of
3832 the directors from single-member districts, to be eligible to be
3933 listed on the ballot as a candidate for or to serve as a director
4034 from a single-member district, a person must be a resident of that
4135 district.
4236 SECTION 2. The changes in law made by Sections 7218.052 and
4337 7218.053, Special District Local Laws Code, as added by this Act, do
4438 not affect the entitlement of a member serving on the board of
4539 directors of the Jonah Water Special Utility District immediately
4640 before the effective date of this Act to continue to carry out the
4741 board's functions for the remainder of the member's term. The
4842 changes in law apply only to a member elected on or after the
4943 effective date of this Act. This Act does not prohibit a person who
5044 is a member of the board on the effective date of this Act from being
5145 reelected to the board if the person has the qualifications
5246 required for a member under Sections 7218.052 and 7218.053, Special
5347 District Local Laws Code, as added by this Act.
5448 SECTION 3. (a) The legal notice of the intention to
5549 introduce this Act, setting forth the general substance of this
5650 Act, has been published as provided by law, and the notice and a
5751 copy of this Act have been furnished to all persons, agencies,
5852 officials, or entities to which they are required to be furnished
5953 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6054 Government Code.
6155 (b) The governor, one of the required recipients, has
6256 submitted the notice and Act to the Texas Commission on
6357 Environmental Quality.
6458 (c) The Texas Commission on Environmental Quality has filed
6559 its recommendations relating to this Act with the governor, the
6660 lieutenant governor, and the speaker of the house of
6761 representatives within the required time.
6862 (d) All requirements of the constitution and laws of this
6963 state and the rules and procedures of the legislature with respect
7064 to the notice, introduction, and passage of this Act are fulfilled
7165 and accomplished.
7266 SECTION 4. This Act takes effect September 1, 2015.
