11	5		relating to the qualifications and method of electing directors of
12	6		the Jonah Water Special Utility District.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Subtitle C, Title 6, Special District Local Laws
15	9		Code, is amended by adding Chapter 7218 to read as follows:
16	10		CHAPTER 7218. JONAH WATER SPECIAL UTILITY DISTRICT
17	11		SUBCHAPTER A. GENERAL PROVISIONS
18	12		Sec. 7218.001. DEFINITIONS. In this chapter:
19	13		(1) "Board" means the board of directors of the
20	14		district.
21	15		(2) "Director" means a member of the board.
22	16		(3) "District" means the Jonah Water Special Utility
23	17		District.
24	18		SUBCHAPTER B. BOARD OF DIRECTORS
25	19		Sec. 7218.051. COMPOSITION OF BOARD. The district is
26	20		governed by a board of nine directors.
27	21		Sec. 7218.052. DIRECTOR ELIGIBILITY. To be eligible to be
28	22		listed on the ballot as a candidate for or to serve as a director, a
29	23		person must be:
30	24		(1) a resident of the district; and
31	25		(2) a retail water or sewer service customer of the
32	26		district.
33	27		Sec. 7218.053. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
34	28		DISTRICTS. (a) The board by rule may provide for the election of
35	29		some or all of the directors from single-member districts.
36	30		(b) In addition to the qualifications required by Section
37	31		7218.052, if the board provides for the election of some or all of
38	32		the directors from single-member districts, to be eligible to be
39	33		listed on the ballot as a candidate for or to serve as a director
40	34		from a single-member district, a person must be a resident of that
41	35		district.
42	36		SECTION 2. The changes in law made by Sections 7218.052 and
43	37		7218.053, Special District Local Laws Code, as added by this Act, do
44	38		not affect the entitlement of a member serving on the board of
45	39		directors of the Jonah Water Special Utility District immediately
46	40		before the effective date of this Act to continue to carry out the
47	41		board's functions for the remainder of the member's term. The
48	42		changes in law apply only to a member elected on or after the
49	43		effective date of this Act. This Act does not prohibit a person who
50	44		is a member of the board on the effective date of this Act from being
51	45		reelected to the board if the person has the qualifications
52	46		required for a member under Sections 7218.052 and 7218.053, Special
53	47		District Local Laws Code, as added by this Act.
54	48		SECTION 3. (a) The legal notice of the intention to
55	49		introduce this Act, setting forth the general substance of this
56	50		Act, has been published as provided by law, and the notice and a
57	51		copy of this Act have been furnished to all persons, agencies,
58	52		officials, or entities to which they are required to be furnished
59	53		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
60	54		Government Code.
61	55		(b) The governor, one of the required recipients, has
62	56		submitted the notice and Act to the Texas Commission on
63	57		Environmental Quality.
64	58		(c) The Texas Commission on Environmental Quality has filed
65	59		its recommendations relating to this Act with the governor, the
66	60		lieutenant governor, and the speaker of the house of
67	61		representatives within the required time.
68	62		(d) All requirements of the constitution and laws of this
69	63		state and the rules and procedures of the legislature with respect
70	64		to the notice, introduction, and passage of this Act are fulfilled
71	65		and accomplished.
72	66		SECTION 4. This Act takes effect September 1, 2015.
