225 relating to requiring personnel of abortion facilities and certain
236 other facilities performing abortions to complete training on human
247 trafficking.
258 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
269 SECTION 1. Chapter 171, Health and Safety Code, is amended
2710 by adding Subchapter E to read as follows:
2811 SUBCHAPTER E. EDUCATION AND TRAINING PROGRAMS ON TRAFFICKING OF
2912 PERSONS FOR CERTAIN FACILITY PERSONNEL
3013 Sec. 171.081. APPLICABILITY. This subchapter applies to
3114 each person who:
3215 (1) is employed by, volunteers at, or performs
3316 services under contract with:
3417 (A) an abortion facility licensed under Chapter
3518 245; or
3619 (B) an ambulatory surgical center licensed under
3720 Chapter 243 that performs more than 50 abortions in any 12-month
3821 period; and
3922 (2) has direct contact with patients of the facility.
4023 Sec. 171.082. EDUCATION AND TRAINING PROGRAMS ON
4124 TRAFFICKING OF PERSONS. (a) The executive commissioner of the
4225 Health and Human Services Commission by rule shall require a person
4326 described by Section 171.081 to complete within a reasonable time
4427 after beginning work at the facility a training program to identify
4528 and assist victims of human trafficking.
4629 (b) A training program under this section must use the
4730 standardized curriculum created by the human trafficking
4831 prevention task force under Section 402.035(d)(6), Government
4932 Code.
5033 (c) The department shall make available to each facility
5134 described by Sections 171.081(1)(A) and (B) the training program
5235 required under this section.
5336 SECTION 2. Not later than December 1, 2015, the executive
5437 commissioner of the Health and Human Services Commission shall
5538 adopt the rules required by Section 171.082, Health and Safety
5639 Code, as added by this Act.
5740 SECTION 3. A person described by Section 171.081, Health
5841 and Safety Code, as added by this Act, who is hired, begins
5942 volunteering, or begins providing services under contract before
6043 September 1, 2015, is not required to comply with Section 171.082,
6144 Health and Safety Code, as added by this Act, before September 1,
6245 2016.
6346 SECTION 4. This Act takes effect immediately if it receives
6447 a vote of two-thirds of all the members elected to each house, as
6548 provided by Section 39, Article III, Texas Constitution. If this
6649 Act does not receive the vote necessary for immediate effect, this
6750 Act takes effect September 1, 2015.
