21	4		AN ACT
22	5		relating to requiring personnel of abortion facilities and certain
23	6		other facilities performing abortions to complete training on human
24	7		trafficking.
25	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
26	9		SECTION 1. Chapter 171, Health and Safety Code, is amended
27	10		by adding Subchapter E to read as follows:
28	11		SUBCHAPTER E. EDUCATION AND TRAINING PROGRAMS ON TRAFFICKING OF
29	12		PERSONS FOR CERTAIN FACILITY PERSONNEL
30	13		Sec. 171.081. APPLICABILITY. This subchapter applies to
31	14		each person who:
32	15		(1) is employed by, volunteers at, or performs
33	16		services under contract with:
34	17		(A) an abortion facility licensed under Chapter
35	18		245; or
36	19		(B) an ambulatory surgical center licensed under
37	20		Chapter 243 that performs more than 50 abortions in any 12-month
38	21		period; and
39	22		(2) has direct contact with patients of the facility.
40	23		Sec. 171.082. EDUCATION AND TRAINING PROGRAMS ON
41	24		TRAFFICKING OF PERSONS. (a) The executive commissioner of the
42	25		Health and Human Services Commission by rule shall require a person
43	26		described by Section 171.081 to complete within a reasonable time
44	27		after beginning work at the facility a training program to identify
45	28		and assist victims of human trafficking.
46	29		(b) A training program under this section must use the
47	30		standardized curriculum created by the human trafficking
48	31		prevention task force under Section 402.035(d)(6), Government
49	32		Code.
50	33		(c) The department shall make available to each facility
51	34		described by Sections 171.081(1)(A) and (B) the training program
52	35		required under this section.
53	36		SECTION 2. Not later than December 1, 2015, the executive
54	37		commissioner of the Health and Human Services Commission shall
55	38		adopt the rules required by Section 171.082, Health and Safety
56	39		Code, as added by this Act.
57	40		SECTION 3. A person described by Section 171.081, Health
58	41		and Safety Code, as added by this Act, who is hired, begins
59	42		volunteering, or begins providing services under contract before
60	43		September 1, 2015, is not required to comply with Section 171.082,
61	44		Health and Safety Code, as added by this Act, before September 1,
62	45		2016.
63	46		SECTION 4. This Act takes effect immediately if it receives
64	47		a vote of two-thirds of all the members elected to each house, as
65	48		provided by Section 39, Article III, Texas Constitution. If this
66	49		Act does not receive the vote necessary for immediate effect, this
67	50		Act takes effect September 1, 2015.
