13 | 6 | | recommend revisions to any state laws pertaining to juvenile |

15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 9 | | SECTION 1. DEFINITIONS. In this Act: |
---|
17 | 10 | | (1) "Advisory committee" means the Juvenile Records |
---|
18 | 11 | | Advisory Committee appointed under Section 2 of this Act. |
---|
19 | 12 | | (2) "Board" means the Texas Juvenile Justice Board. |
---|
20 | 13 | | SECTION 2. JUVENILE RECORDS ADVISORY COMMITTEE. Not later |
---|
21 | 14 | | than December 1, 2015, the board shall appoint an advisory |
---|
22 | 15 | | committee to develop a plan for studying, reorganizing, and |
---|
23 | 16 | | comprehensively revising Chapter 58, Family Code, and any other |
---|
24 | 17 | | relevant laws pertaining to juvenile records. |
---|
25 | 18 | | SECTION 3. APPOINTMENTS; PRESIDING OFFICER. (a) In making |
---|
26 | 19 | | appointments to the advisory committee, the board shall include |
---|
27 | 20 | | members who are interested parties, including: |
---|
28 | 21 | | (1) chief juvenile probation officers; |
---|
29 | 22 | | (2) juvenile prosecutors; |
---|
30 | 23 | | (3) juvenile defense attorneys; |
---|
31 | 24 | | (4) juvenile court judges; |
---|
32 | 25 | | (5) justice court or municipal court judges; |
---|
33 | 26 | | (6) court administrators or court clerks; |
---|
34 | 27 | | (7) peace officers; |
---|
35 | 28 | | (8) representatives of the Department of Public |
---|
36 | 29 | | Safety; |
---|
37 | 30 | | (9) representatives of the Department of Family and |
---|
38 | 31 | | Protective Services; |
---|
39 | 32 | | (10) representatives of the Texas Juvenile Justice |
---|
40 | 33 | | Department; |
---|
41 | 34 | | (11) juvenile justice advocates; |
---|
42 | 35 | | (12) individuals with expertise in federal records and |
---|
43 | 36 | | federal immigration policy; |
---|
44 | 37 | | (13) members of the public; and |
---|
45 | 38 | | (14) any other individuals that the board considers |
---|
46 | 39 | | necessary to accomplish the duties of the advisory committee. |
---|
47 | 40 | | (b) The board shall designate one of the members as |
---|
48 | 41 | | presiding officer of the advisory committee. |
---|
49 | 42 | | SECTION 4. REPORT. (a) Not later than November 1, 2016, |
---|
50 | 43 | | the advisory committee shall submit to the legislature and the |
---|
51 | 44 | | board the recommendations for revisions to Chapter 58, Family Code, |
---|
52 | 45 | | and any other relevant laws pertaining to juvenile records and a |
---|
53 | 46 | | copy of the plan developed by the committee under Section 2 of this |
---|
54 | 47 | | Act to produce those recommendations. |
---|
55 | 48 | | (b) The advisory committee may submit: |
---|
56 | 49 | | (1) preliminary recommendations at any time before |
---|
57 | 50 | | submitting the report required under Subsection (a) of this |
---|
58 | 51 | | section; and |
---|
59 | 52 | | (2) follow-up recommendations at any time after |
---|
60 | 53 | | submitting the report required under Subsection (a) of this |
---|
61 | 54 | | section. |
---|
62 | 55 | | SECTION 5. COMPENSATION. Members of the advisory committee |
---|
63 | 56 | | serve without compensation and are not entitled to reimbursement |
---|
64 | 57 | | for expenses. |
---|
65 | 58 | | SECTION 6. APPLICATION OF LAWS GOVERNING ADVISORY |
---|
66 | 59 | | COMMITTEES. The advisory committee is not subject to Chapter 2110, |
---|
67 | 60 | | Government Code. |
---|
68 | 61 | | SECTION 7. EXPIRATION DATE. The advisory committee is |
---|
69 | 62 | | abolished and this Act expires December 31, 2018. |
---|
70 | 63 | | SECTION 8. EFFECTIVE DATE. This Act takes effect |
---|
71 | 64 | | immediately if it receives a vote of two-thirds of all the members |
---|
72 | 65 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
73 | 66 | | Constitution. If this Act does not receive the vote necessary for |
---|
74 | 67 | | immediate effect, this Act takes effect September 1, 2015. |
