| 14 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 8 | | SECTION 1. Section 41.102(a), Government Code, is amended |
|---|
| 16 | 9 | | to read as follows: |
|---|
| 17 | 10 | | (a) A prosecuting attorney may employ the assistant |
|---|
| 18 | 11 | | prosecuting attorneys, investigators, secretaries, and other |
|---|
| 19 | 12 | | office personnel that in the prosecuting attorney's [his] judgment |
|---|
| 20 | 13 | | are required for the proper and efficient operation and |
|---|
| 21 | 14 | | administration of the office. The commissioners court may |
|---|
| 22 | 15 | | authorize a prosecuting attorney to appoint reserve investigators. |
|---|
| 23 | 16 | | The commissioners court may limit the number of reserve |
|---|
| 24 | 17 | | investigators that a prosecuting attorney may appoint. A reserve |
|---|
| 25 | 18 | | investigator may accept other employment or compensation that does |
|---|
| 26 | 19 | | not impair the reserve investigator's independence in the |
|---|
| 27 | 20 | | performance of the reserve investigator's duties for the |
|---|
| 28 | 21 | | prosecuting attorney. |

| 29 | 22 | | SECTION 2. This Act takes effect September 1, 2015. |
