| 12 | 5 | | relating to a prohibition of limitations on the number of dual |

| 13 | 6 | | credit courses or hours in which a public high school student may |
|---|

| 15 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 9 | | SECTION 1. Section 28.009(b), Education Code, is amended to |
|---|
| 17 | 10 | | read as follows: |
|---|
| 18 | 11 | | (b) The agency shall coordinate with the Texas Higher |
|---|
| 19 | 12 | | Education Coordinating Board as necessary in administering this |
|---|
| 20 | 13 | | section. The commissioner may adopt rules as necessary concerning |
|---|
| 21 | 14 | | the duties under this section of a school district. The Texas |
|---|
| 22 | 15 | | Higher Education Coordinating Board may adopt rules as necessary |
|---|
| 23 | 16 | | concerning the duties under this section of a public institution of |
|---|
| 24 | 17 | | higher education. A rule may not limit: |
|---|
| 25 | 18 | | (1) the number of dual credit courses or hours in which |
|---|
| 26 | 19 | | a student may enroll while in high school; |
|---|
| 27 | 20 | | (2) the number of dual credit courses or hours in which |
|---|
| 28 | 21 | | a student may enroll each semester or academic year; or |
|---|
| 29 | 22 | | (3) the grade levels at which a high school student may |
|---|
| 30 | 23 | | be eligible to enroll in a dual credit course. |
|---|
| 31 | 24 | | SECTION 2. Section 130.008(f), Education Code, is repealed. |
|---|
| 32 | 25 | | SECTION 3. This Act applies beginning with the 2015-2016 |
|---|
| 33 | 26 | | school year. |
|---|
| 34 | 27 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 31 | | Act takes effect September 1, 2015. |
