114 AN ACT
125 relating to a prohibition of limitations on the number of dual
136 credit courses or hours in which a public high school student may
147 enroll.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Section 28.009(b), Education Code, is amended to
1710 read as follows:
1811 (b) The agency shall coordinate with the Texas Higher
1912 Education Coordinating Board as necessary in administering this
2013 section. The commissioner may adopt rules as necessary concerning
2114 the duties under this section of a school district. The Texas
2215 Higher Education Coordinating Board may adopt rules as necessary
2316 concerning the duties under this section of a public institution of
2417 higher education. A rule may not limit:
2518 (1) the number of dual credit courses or hours in which
2619 a student may enroll while in high school;
2720 (2) the number of dual credit courses or hours in which
2821 a student may enroll each semester or academic year; or
2922 (3) the grade levels at which a high school student may
3023 be eligible to enroll in a dual credit course.
3124 SECTION 2. Section 130.008(f), Education Code, is repealed.
3225 SECTION 3. This Act applies beginning with the 2015-2016
3326 school year.
3427 SECTION 4. This Act takes effect immediately if it receives
3528 a vote of two-thirds of all the members elected to each house, as
3629 provided by Section 39, Article III, Texas Constitution. If this
3730 Act does not receive the vote necessary for immediate effect, this
3831 Act takes effect September 1, 2015.
