97 relating to the process for establishing speed limits on roads near
108 certain schools.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 545.355(b), Transportation Code, is
1311 amended to read as follows:
1412 (b) The commissioners court of a county may declare a lower
1513 speed limit of not less than:
1614 (1) 30 miles per hour on a county road or highway to
1715 which this section applies, if the commissioners court determines
1816 that the prima facie speed limit on the road or highway is
1917 unreasonable or unsafe; [or]
2018 (2) 20 miles per hour in a residence district, unless
2119 the roadway has been designated as a major thoroughfare by a city
2220 planning commission; or
2321 (3) 15 miles per hour on a county road or highway
2422 located within 500 feet of an elementary, secondary, or
2523 open-enrollment charter school or an institution of higher
2624 education, if approved under Section 545.357.
2725 SECTION 2. Section 545.357, Transportation Code, is amended
2826 to read as follows:
2927 Sec. 545.357. CONSIDERATION OF [PUBLIC HEARING TO CONSIDER]
3028 SPEED LIMITS WHERE CERTAIN SCHOOLS ARE LOCATED. (a) The governing
3129 body of a municipality in which a public or private elementary or
3230 secondary school, an open-enrollment charter school as defined by
3331 Section 5.001(6), Education Code, or an institution of higher
3432 education as defined by Section 61.003(8) or (15), Education Code,
3533 is located shall, on request of the governing body of a school or
3634 institution of higher education, hold a public hearing at least
3735 once each calendar year to consider prima facie speed limits on a
3836 highway in the municipality, including a highway of the state
3937 highway system, near the school or institution of higher education.
4038 (b) If a county road outside the state highway system is
4139 located within 500 feet of a public or private elementary or
4240 secondary school, an open-enrollment charter school, or an
4341 institution of higher education that is not in a municipality, the
4442 commissioners court of the county, on request of the governing body
4543 of a school or institution of higher education, shall hold a public
4644 hearing at least once each calendar year to consider the prima facie
4745 speed limit on the road near the school or institution of higher
4846 education.
4947 (c) A municipal governing body or commissioners court, on
5048 request of the governing body of a school or institution of higher
5149 education, may hold one public hearing for all public and private
5250 elementary and secondary schools, open-enrollment charter schools,
5351 and institutions of higher education in its jurisdiction.
5452 (d) The Texas Transportation Commission, on request of the
5553 governing body of a school or institution of higher education,
5654 shall hold a public hearing at least once each calendar year to
5755 consider prima facie speed limits on highways in the state highway
5856 system that are near public or private elementary or secondary
5957 schools, open-enrollment charter schools, or institutions of
6058 higher education.
6159 (e) The municipal governing body, the commissioners court,
6260 or the Texas Transportation Commission, as applicable, may not
6361 reject a request for a prima facie speed limit by a public or
6462 private elementary or secondary school, an open-enrollment charter
6563 school, or an institution of higher education without first making
6664 a written finding stating a reasonable basis for the rejection.
6765 (f) The governing body of a school or institution of higher
6866 education may appeal a rejection of a request for a prima facie
6967 speed limit under this section to the district court of the county
7068 in which the school or institution is located not later than the
7169 90th day after the date the written finding is made. If the
7270 governing body shows by clear and convincing evidence that the
7371 rejection of the request was not based on accepted traffic
7472 management principles, the district court may grant the requested
7573 prima facie speed limit.
7674 (g) The governing body of a school or institution of higher
7775 education may consult with the Texas Department of Transportation,
7876 the Texas Transportation Commission, and local transportation
7977 authorities on the feasibility of a prima facie speed limit during
8078 the acquisition and design of property for a public or private
8179 elementary or secondary school, an open-enrollment charter school,
8280 or an institution of higher education.
8381 (h) In this section, "governing body of a school or
8482 institution of higher education" means:
8583 (1) the board of trustees of the school district in
8684 which a public elementary or secondary school is located;
8785 (2) the governing body of a private elementary or
8886 secondary school;
8987 (3) the governing body of an open-enrollment charter
9088 school; or
9189 (4) the governing board of an institution of higher
9290 education.
9391 SECTION 3. This Act takes effect September 1, 2015.
