55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a task force to evaluate the English
88 language proficiency standards used in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 29, Education Code, is
1111 amended by adding Section 29.067 to read as follows:
1212 Sec. 29.067. TASK FORCE ON ENGLISH LANGUAGE PROFICIENCY
1313 STANDARDS. (a) A task force is established under this section to
1414 evaluate the efficacy of the agency's English language proficiency
1515 standards for students in grades 9-12.
1616 (b) The task force shall be composed of the following
1717 members appointed by the commissioner:
1818 (1) five teachers who are certified in bilingual
1919 education, with appointments reflecting the geographic diversity
2020 of this state and including teachers from both rural and urban
2121 school districts;
2222 (2) one representative of the agency with expertise
2323 related to the English language proficiency standards;
2424 (3) one representative of the agency with expertise
2525 related to the Texas essential knowledge and skills;
2626 (4) one central office administrator from an urban
2727 school district and one central office administrator from a rural
2828 school district; and
2929 (5) one superintendent of a school district that has a
3030 proportionately high number of students of limited English
3131 proficiency.
3232 (c) The member of the task force appointed under Subsection
3333 (b)(2) shall serve as the presiding officer of the task force.
3434 (d) The commissioner shall appoint the members of the task
3535 force not later than December 1, 2015.
3636 (e) The presiding officer shall call the initial meeting of
3737 the task force on or before January 1, 2016. The task force shall
3838 meet at the times and places that the presiding officer determines
3939 are appropriate. The task force shall adopt rules necessary to
4040 fulfill the task force's duties under this section.
4141 (f) Chapter 2110, Government Code, does not apply to the
4242 task force.
4343 (g) The task force shall:
4444 (1) examine the impact of the agency's English
4545 language proficiency standards on the achievement of students of
4646 limited English proficiency in grades 9-12;
4747 (2) examine the impact of the Texas essential
4848 knowledge and skills on the agency's English language proficiency
4949 standards;
5050 (3) evaluate the efficacy of the agency's English
5151 language proficiency standards for grades 9-12, with a focus on
5252 maintaining quality of instruction and full access to the Texas
5353 essential knowledge and skills curriculum;
5454 (4) identify effective methods for incorporating the
5555 Texas essential knowledge and skills curriculum into the agency's
5656 English language proficiency standards for students in grades 9-12;
5757 (5) examine the impact of the agency's English
5858 language proficiency standards on the achievement of students
5959 enrolled in special education programs; and
6060 (6) examine the performance of students of limited
6161 English proficiency who are evaluated with the agency's English
6262 language proficiency standards against the performance of students
6363 who are proficient in English.
6464 (h) The task force shall prepare a report that includes:
6565 (1) a description of the activities of the task force;
6666 (2) the findings and recommendations of the task
6767 force, including any proposed policy recommendations; and
6868 (3) any proposals for legislation or other matters the
6969 task force considers appropriate.
7070 (i) Not later than September 1, 2017, the task force shall
7171 deliver the report required by Subsection (h) to the governor, the
7272 lieutenant governor, the speaker of the house of representatives,
7373 the chair of the State Board of Education, and the Bilingual/ESL
7474 Unit of the Division of Curriculum in the agency.
7575 (j) The task force is abolished and this section expires
7676 December 1, 2017.
7777 SECTION 2. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2015.
