99 AN ACT
1010 relating to the designation for criminal prosecution and other
1111 purposes of certain chemicals commonly referred to as synthetic
1212 cannabinoids as controlled substances and controlled substance
1313 analogues under the Texas Controlled Substances Act; amending
1414 provisions subject to a criminal penalty.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Sections 481.002(5) and (6), Health and Safety
1717 Code, are amended to read as follows:
1818 (5) "Controlled substance" means a substance,
1919 including a drug, an adulterant, and a dilutant, listed in
2020 Schedules I through V or Penalty Group [Groups] 1, 1-A, [or] 2, 2-A,
2121 3, or [through] 4. The term includes the aggregate weight of any
2222 mixture, solution, or other substance containing a controlled
2323 substance.
2424 (6) "Controlled substance analogue" means:
2525 (A) a substance with a chemical structure
2626 substantially similar to the chemical structure of a controlled
2727 substance in Schedule I or II or Penalty Group 1, 1-A, [or] 2, or
2828 2-A; or
2929 (B) a substance specifically designed to produce
3030 an effect substantially similar to, or greater than, the effect of a
3131 controlled substance in Schedule I or II or Penalty Group 1, 1-A,
3232 [or] 2, or 2-A.
3333 SECTION 2. Section 481.1031, Health and Safety Code, is
3434 amended to read as follows:
3535 Sec. 481.1031. PENALTY GROUP 2-A. (a) In this section:
3636 (1) "Core component" is one of the following:
3737 azaindole, benzimidazole, benzothiazole, carbazole, imidazole,
3838 indane, indazole, indene, indole, pyrazole, pyrazolopyridine,
3939 pyridine, or pyrrole.
4040 (2) "Group A component" is one of the following:
4141 adamantane, benzene, cycloalkylmethyl, isoquinoline,
4242 methylpiperazine, naphthalene, phenyl, quinoline,
4343 tetrahydronaphthalene, tetramethylcyclopropane, amino oxobutane,
4444 amino dimethyl oxobutane, amino phenyl oxopropane, methyl methoxy
4545 oxobutane, methoxy dimethyl oxobutane, methoxy phenyl oxopropane,
4646 or an amino acid.
4747 (3) "Link component" is one of the following
4848 functional groups: carboxamide, carboxylate, hydrazide, methanone
4949 (ketone), ethanone, methanediyl (methylene bridge), or methine.
5050 (b) Penalty Group 2-A consists of any material, compound,
5151 mixture, or preparation that contains any quantity of a natural or
5252 synthetic chemical substance, including its salts, isomers, and
5353 salts of isomers, listed by name in this subsection or contained
5454 within one of the structural classes defined in this subsection:
5555 (1) WIN-55,212-2;
5656 (2) Cyclohexylphenol: any compound [that is a
5757 cannabinoid receptor agonist and mimics the pharmacological effect
5858 of naturally occurring cannabinoids, including:
5959 [naphthoylindoles structurally derived from
6060 3-(1-naphthoyl)indole by substitution at the nitrogen atom of the
6161 indole ring by alkyl, alkenyl, cycloalkylmethyl, cycloalkylethyl,
6262 or 2-(4-morpholinyl)ethyl, whether or not further substituted in
6363 the indole ring to any extent, whether or not substituted in the
6464 napthyl ring to any extent, including:

293293 SECTION 3. Section 481.106, Health and Safety Code, is
294294 amended to read as follows:
295295 Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
296296 ANALOGUE. For the purposes of the prosecution of an offense under
297297 this subchapter involving the manufacture, delivery, or possession
298298 of a controlled substance, Penalty Groups 1, 1-A, [and] 2, and 2-A
299299 include a controlled substance analogue that:
300300 (1) has a chemical structure substantially similar to
301301 the chemical structure of a controlled substance listed in the
302302 applicable penalty group; or
303303 (2) is specifically designed to produce an effect
304304 substantially similar to, or greater than, a controlled substance
305305 listed in the applicable penalty group.
306306 SECTION 4. The change in law made by this Act applies only
307307 to an offense committed on or after the effective date of this Act.
308308 An offense committed before the effective date of this Act is
309309 governed by the law in effect on the date the offense was committed,
310310 and the former law is continued in effect for that purpose. For
311311 purposes of this section, an offense was committed before the
312312 effective date of this Act if any element of the offense occurred
313313 before that date.
314314 SECTION 5. This Act takes effect September 1, 2015.
