15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
16 | 16 | | SECTION 1. Sections 481.002(5) and (6), Health and Safety |
---|
17 | 17 | | Code, are amended to read as follows: |
---|
18 | 18 | | (5) "Controlled substance" means a substance, |
---|
19 | 19 | | including a drug, an adulterant, and a dilutant, listed in |
---|
20 | 20 | | Schedules I through V or Penalty Group [Groups] 1, 1-A, [or] 2, 2-A, |
---|
21 | 21 | | 3, or [through] 4. The term includes the aggregate weight of any |
---|
22 | 22 | | mixture, solution, or other substance containing a controlled |
---|
23 | 23 | | substance. |
---|
24 | 24 | | (6) "Controlled substance analogue" means: |
---|
25 | 25 | | (A) a substance with a chemical structure |
---|
26 | 26 | | substantially similar to the chemical structure of a controlled |
---|
27 | 27 | | substance in Schedule I or II or Penalty Group 1, 1-A, [or] 2, or |
---|
28 | 28 | | 2-A; or |
---|
29 | 29 | | (B) a substance specifically designed to produce |
---|
30 | 30 | | an effect substantially similar to, or greater than, the effect of a |
---|
31 | 31 | | controlled substance in Schedule I or II or Penalty Group 1, 1-A, |
---|
32 | 32 | | [or] 2, or 2-A. |
---|
33 | 33 | | SECTION 2. Section 481.1031, Health and Safety Code, is |
---|
34 | 34 | | amended to read as follows: |
---|
35 | 35 | | Sec. 481.1031. PENALTY GROUP 2-A. (a) In this section: |
---|
36 | 36 | | (1) "Core component" is one of the following: |
---|
37 | 37 | | azaindole, benzimidazole, benzothiazole, carbazole, imidazole, |
---|
38 | 38 | | indane, indazole, indene, indole, pyrazole, pyrazolopyridine, |
---|
39 | 39 | | pyridine, or pyrrole. |
---|
40 | 40 | | (2) "Group A component" is one of the following: |
---|
41 | 41 | | adamantane, benzene, cycloalkylmethyl, isoquinoline, |
---|
42 | 42 | | methylpiperazine, naphthalene, phenyl, quinoline, |
---|
43 | 43 | | tetrahydronaphthalene, tetramethylcyclopropane, amino oxobutane, |
---|
44 | 44 | | amino dimethyl oxobutane, amino phenyl oxopropane, methyl methoxy |
---|
45 | 45 | | oxobutane, methoxy dimethyl oxobutane, methoxy phenyl oxopropane, |
---|
46 | 46 | | or an amino acid. |
---|
47 | 47 | | (3) "Link component" is one of the following |
---|
48 | 48 | | functional groups: carboxamide, carboxylate, hydrazide, methanone |
---|
49 | 49 | | (ketone), ethanone, methanediyl (methylene bridge), or methine. |
---|
50 | 50 | | (b) Penalty Group 2-A consists of any material, compound, |
---|
51 | 51 | | mixture, or preparation that contains any quantity of a natural or |
---|
52 | 52 | | synthetic chemical substance, including its salts, isomers, and |
---|
53 | 53 | | salts of isomers, listed by name in this subsection or contained |
---|
54 | 54 | | within one of the structural classes defined in this subsection: |
---|
55 | 55 | | (1) WIN-55,212-2; |
---|
56 | 56 | | (2) Cyclohexylphenol: any compound [that is a |
---|
57 | 57 | | cannabinoid receptor agonist and mimics the pharmacological effect |
---|
58 | 58 | | of naturally occurring cannabinoids, including: |

301 | 301 | | the chemical structure of a controlled substance listed in the |
---|
302 | 302 | | applicable penalty group; or |

303 | 303 | | (2) is specifically designed to produce an effect |

304 | 304 | | substantially similar to, or greater than, a controlled substance |
---|
305 | 305 | | listed in the applicable penalty group. |
---|
306 | 306 | | SECTION 4. The change in law made by this Act applies only |
---|
307 | 307 | | to an offense committed on or after the effective date of this Act. |
---|
308 | 308 | | An offense committed before the effective date of this Act is |
---|
309 | 309 | | governed by the law in effect on the date the offense was committed, |
---|
310 | 310 | | and the former law is continued in effect for that purpose. For |
---|
311 | 311 | | purposes of this section, an offense was committed before the |
---|
312 | 312 | | effective date of this Act if any element of the offense occurred |
---|
313 | 313 | | before that date. |
---|
314 | 314 | | SECTION 5. This Act takes effect September 1, 2015. |
