77 relating to sunset review of certain municipal management
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 375, Local Government
1111 Code, is amended by adding Section 375.005 to read as follows:
1212 Sec. 375.005. SUNSET REVIEW OF MUNICIPAL MANAGEMENT
1313 DISTRICTS IN CERTAIN COUNTIES. (a) A municipal management or other
1414 district to which this chapter applies or that incorporates a power
1515 provided by this chapter is subject to review under Chapter 325,
1616 Government Code (Texas Sunset Act), as if it were a state agency
1717 subject to review under that chapter but may not be abolished under
1818 that chapter without further legislative action.
1919 (b) A district shall be reviewed as if the district were
2020 scheduled to be abolished on September 1 of the eighth year after
2121 the date the bill creating the district was enacted.
2222 (c) This section applies only to a district located in a
2323 county with a population of 3.3 million or more.
2424 (d) A district shall pay the cost incurred by the Sunset
2525 Advisory Commission in performing a review of the district under
2626 this section. The Sunset Advisory Commission shall determine the
2727 cost, and the district shall pay the amount promptly on receipt of a
2828 statement from the Sunset Advisory Commission detailing the cost.
2929 SECTION 2. Section 375.005, Local Government Code, as added
3030 by this Act, applies only to a district created on or after the
3131 effective date of this Act.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2015.
