A BILL TO BE ENTITLED
AN ACT
relating to sunset review of certain municipal management
districts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 375, Local Government
Code, is amended by adding Section 375.005 to read as follows:
Sec. 375.005. SUNSET REVIEW OF MUNICIPAL MANAGEMENT
DISTRICTS IN CERTAIN COUNTIES. (a) A municipal management or other
district to which this chapter applies or that incorporates a power
provided by this chapter is subject to review under Chapter 325,
Government Code (Texas Sunset Act), as if it were a state agency
subject to review under that chapter but may not be abolished under
that chapter without further legislative action.
(b) A district shall be reviewed as if the district were
scheduled to be abolished on September 1 of the eighth year after
the date the bill creating the district was enacted.
(c) This section applies only to a district located in a
county with a population of 3.3 million or more.
(d) A district shall pay the cost incurred by the Sunset
Advisory Commission in performing a review of the district under
this section. The Sunset Advisory Commission shall determine the
cost, and the district shall pay the amount promptly on receipt of a
statement from the Sunset Advisory Commission detailing the cost.
SECTION 2. Section 375.005, Local Government Code, as added
by this Act, applies only to a district created on or after the
effective date of this Act.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2015.
