126 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
137 SECTION 1. Subchapter A, Chapter 241, Health and Safety
148 Code, is amended by adding Section 241.010 to read as follows:
159 Sec. 241.010. DISPOSITION OF FETAL REMAINS. (a) A hospital
1610 shall release the remains of an unintended, intrauterine fetal
1711 death on the request of a parent of the unborn child, in a manner
1812 appropriate under law and the hospital's policy for disposition of
1913 a human body.
2014 (b) Notwithstanding Subsection (a), if the remains of an
2115 unintended, intrauterine fetal death weigh less than 350 grams, a
2216 hospital shall release the remains on the request of a parent of the
2317 unborn child, in a manner that is appropriate under law and
2418 consistent with hospital policy.
2519 SECTION 2. This Act takes effect September 1, 2015.
