9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 150.021(b), Local Government Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) The prohibition under Subsection (a) does not apply to | |
13 | 13 | residency requirements for: | |
14 | 14 | (1) candidates for or holders of a municipal office, | |
15 | 15 | including a position on the governing body of the municipality; | |
16 | 16 | [or] | |
17 | 17 | (2) municipal department heads appointed by the mayor | |
18 | 18 | or governing body of the municipality; or | |
19 | 19 | (3) peace officers as defined by Article 2.12, Code of | |
20 | 20 | Criminal Procedure, or other law, employed by a municipality with a | |
21 | 21 | population of two million or more. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2015. |
