12 | 6 | | establish a policy on campus sexual assault. |

13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
14 | 8 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
---|
15 | 9 | | amended by adding Section 51.9363 to read as follows: |
---|
16 | 10 | | Sec. 51.9363. CAMPUS SEXUAL ASSAULT POLICY. (a) In this |
---|
17 | 11 | | section, "institution of higher education" has the meaning assigned |
---|
18 | 12 | | by Section 61.003. |
---|
19 | 13 | | (b) Each institution of higher education shall adopt a |
---|
20 | 14 | | policy on campus sexual assault. The policy must: |
---|
21 | 15 | | (1) include: |
---|
22 | 16 | | (A) definitions of prohibited behavior; |
---|
23 | 17 | | (B) sanctions for violations; and |
---|
24 | 18 | | (C) the protocol for reporting and responding to |
---|
25 | 19 | | reports of campus sexual assault; and |
---|
26 | 20 | | (2) be approved by the institution's governing board |
---|
27 | 21 | | before final adoption by the institution. |
---|
28 | 22 | | (c) Each institution of higher education shall make the |
---|
29 | 23 | | institution's campus sexual assault policy available to students, |
---|
30 | 24 | | faculty, and staff members by: |
---|
31 | 25 | | (1) including the policy in the institution's student |
---|
32 | 26 | | handbook and personnel handbook; and |
---|
33 | 27 | | (2) creating and maintaining a web page on the |
---|
34 | 28 | | institution's Internet website dedicated solely to the policy. |
---|
35 | 29 | | (d) Each institution of higher education shall require each |
---|
36 | 30 | | entering freshman or undergraduate transfer student to attend an |
---|
37 | 31 | | orientation on the institution's campus sexual assault policy |
---|
38 | 32 | | before or during the first semester or term in which the student is |
---|
39 | 33 | | enrolled at the institution. The institution shall establish the |
---|
40 | 34 | | format and content of the orientation. |
---|
41 | 35 | | (e) Each biennium, each institution of higher education |
---|
42 | 36 | | shall review the institution's campus sexual assault policy and, |
---|
43 | 37 | | with approval of the institution's governing board, revise the |
---|
44 | 38 | | policy as necessary. |
---|
45 | 39 | | SECTION 2. Section 51.9363, Education Code, as added by |
---|
46 | 40 | | this Act, applies beginning with the 2015 fall semester. |
---|
47 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
---|
48 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 45 | | Act takes effect September 1, 2015. |
