104 AN ACT
115 relating to requiring public institutions of higher education to
126 establish a policy on campus sexual assault.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
159 amended by adding Section 51.9363 to read as follows:
1610 Sec. 51.9363. CAMPUS SEXUAL ASSAULT POLICY. (a) In this
1711 section, "institution of higher education" has the meaning assigned
1812 by Section 61.003.
1913 (b) Each institution of higher education shall adopt a
2014 policy on campus sexual assault. The policy must:
2115 (1) include:
2216 (A) definitions of prohibited behavior;
2317 (B) sanctions for violations; and
2418 (C) the protocol for reporting and responding to
2519 reports of campus sexual assault; and
2620 (2) be approved by the institution's governing board
2721 before final adoption by the institution.
2822 (c) Each institution of higher education shall make the
2923 institution's campus sexual assault policy available to students,
3024 faculty, and staff members by:
3125 (1) including the policy in the institution's student
3226 handbook and personnel handbook; and
3327 (2) creating and maintaining a web page on the
3428 institution's Internet website dedicated solely to the policy.
3529 (d) Each institution of higher education shall require each
3630 entering freshman or undergraduate transfer student to attend an
3731 orientation on the institution's campus sexual assault policy
3832 before or during the first semester or term in which the student is
3933 enrolled at the institution. The institution shall establish the
4034 format and content of the orientation.
4135 (e) Each biennium, each institution of higher education
4236 shall review the institution's campus sexual assault policy and,
4337 with approval of the institution's governing board, revise the
4438 policy as necessary.
4539 SECTION 2. Section 51.9363, Education Code, as added by
4640 this Act, applies beginning with the 2015 fall semester.
4741 SECTION 3. This Act takes effect immediately if it receives
4842 a vote of two-thirds of all the members elected to each house, as
4943 provided by Section 39, Article III, Texas Constitution. If this
5044 Act does not receive the vote necessary for immediate effect, this
5145 Act takes effect September 1, 2015.
