88 AN ACT
99 relating to the appeal of waiver of jurisdiction and transfer to
1010 criminal court in juvenile cases.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 4.18(g), Code of Criminal Procedure, is
1313 amended to read as follows:
1414 (g) This article does not apply to a claim of a defect or
1515 error in a discretionary transfer proceeding in juvenile court. A
1616 defendant may appeal a defect or error only as provided by Chapter
1717 56, Family Code [Article 44.47].
1818 SECTION 2. Section 51.041(a), Family Code, is amended to
1919 read as follows:
2020 (a) The court retains jurisdiction over a person, without
2121 regard to the age of the person, for conduct engaged in by the
2222 person before becoming 17 years of age if, as a result of an appeal
2323 by the person or the state under Chapter 56 [or by the person under
2424 Article 44.47, Code of Criminal Procedure,] of an order of the
2525 court, the order is reversed or modified and the case remanded to
2626 the court by the appellate court.
2727 SECTION 3. Sections 56.01(c) and (h), Family Code, are
2828 amended to read as follows:
2929 (c) An appeal may be taken:
3030 (1) except as provided by Subsection (n), by or on
3131 behalf of a child from an order entered under:
3232 (A) Section 54.02 respecting transfer of the
3333 child for prosecution as an adult;
3434 (B) Section 54.03 with regard to delinquent
3535 conduct or conduct indicating a need for supervision;
3636 (C) [(B)] Section 54.04 disposing of the case;
3737 (D) [(C)] Section 54.05 respecting modification
3838 of a previous juvenile court disposition; or
3939 (E) [(D)] Chapter 55 by a juvenile court
4040 committing a child to a facility for the mentally ill or
4141 intellectually disabled [mentally retarded]; or
4242 (2) by a person from an order entered under Section
4343 54.11(i)(2) transferring the person to the custody of the Texas
4444 Department of Criminal Justice.
4545 (h) If the order appealed from takes custody of the child
4646 from the child's [his] parent, guardian, or custodian or waives
4747 jurisdiction under Section 54.02 and transfers the child to
4848 criminal court for prosecution, the appeal has precedence over all
4949 other cases. The supreme court shall adopt rules ensuring the
5050 acceleration of the disposition by the appellate court and the
5151 supreme court of an appeal of an order waiving jurisdiction under
5252 Section 54.02 and transferring a child to criminal court for
5353 prosecution.
5454 SECTION 4. Article 44.47, Code of Criminal Procedure, is
5555 repealed.
5656 SECTION 5. The change in law made by this Act applies only
5757 to an order of a juvenile court waiving jurisdiction and
5858 transferring a child to criminal court that is issued on or after
5959 the effective date of this Act. An order of a juvenile court waiving
6060 jurisdiction and transferring a child to criminal court that is
6161 issued before the effective date of this Act is governed by the law
6262 in effect on the date the order was issued, and the former law is
6363 continued in effect for that purpose.
6464 SECTION 6. This Act takes effect September 1, 2015.
