| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 430.002, Transportation Code, is amended |
|---|
| 15 | 9 | | to read as follows: |
|---|
| 16 | 10 | | Sec. 430.002. [SPEED FEEDBACK] SIGNS ERECTED BY |
|---|
| 17 | 11 | | NEIGHBORHOOD ASSOCIATION. (a) In this section, "property owners' |
|---|
| 18 | 12 | | association" means an association described by Section 204.004, |
|---|
| 19 | 13 | | Property Code. |
|---|
| 20 | 14 | | (b) A property owners' association may install a speed |
|---|
| 21 | 15 | | feedback sign or a solar-powered light-emitting diode (LED) stop |
|---|
| 22 | 16 | | sign on a road, highway, or street in the association's |
|---|
| 23 | 17 | | jurisdiction if: |
|---|
| 24 | 18 | | (1) the association receives the consent of the |
|---|
| 25 | 19 | | governing body of the political subdivision that maintains the |
|---|
| 26 | 20 | | road, highway, or street for the placement of the sign; and |
|---|
| 27 | 21 | | (2) the association pays for the installation of the |
|---|
| 28 | 22 | | sign. |
|---|
| 29 | 23 | | (c) A property owners' association that installs a [speed |
|---|
| 30 | 24 | | feedback] sign under this section is responsible for the |
|---|
| 31 | 25 | | maintenance of the sign. |
|---|
| 32 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 30 | | Act takes effect September 1, 2015. |
