11	5		relating to the exemption from vehicle registration for certain
12	6		farm vehicles owned by a farmers' cooperative society or marketing
13	7		association.
14	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	9		SECTION 1. Section 502.146, Transportation Code, is amended
16	10		by adding Subsection (c-1) and amending Subsections (e) and (h) to
17	11		read as follows:
18	12		(c-1) An exemption provided by this section applies to a
19	13		vehicle owned by a farmers' cooperative society incorporated under
20	14		Chapter 51, Agriculture Code, or a marketing association organized
21	15		under Chapter 52, Agriculture Code, and used by members of the
22	16		society or association for a fee if the vehicle otherwise meets the
23	17		requirements for the exemption.
24	18		(e) Except as provided by Subsection (c-1), this [This]
25	19		section does not apply to a farm trailer or farm semitrailer that:
26	20		(1) is used for hire;
27	21		(2) has metal tires operating in contact with the
28	22		highway;
29	23		(3) is not equipped with an adequate hitch pinned or
30	24		locked so that it will remain securely engaged to the towing vehicle
31	25		while in motion; or
32	26		(4) is not operated and equipped in compliance with
33	27		all other law.
34	28		(h) A specialty license plate may not be issued under
35	29		Subsection (a) to an owner of a vehicle described by Subsection
36	30		(b)(1) unless the vehicle's owner provides a registration number
37	31		issued by the comptroller under Section 151.1551, Tax Code, or the
38	32		vehicle is owned by a farmers' cooperative society incorporated
39	33		under Chapter 51, Agriculture Code, or a marketing association
40	34		organized under Chapter 52, Agriculture Code. The comptroller
41	35		shall allow access to the online system established under Section
42	36		151.1551(l), Tax Code, to verify a registration number provided
43	37		under this subsection.
44	38		SECTION 2. This Act takes effect immediately if it receives
45	39		a vote of two-thirds of all the members elected to each house, as
46	40		provided by Section 39, Article III, Texas Constitution. If this
47	41		Act does not receive the vote necessary for immediate effect, this
48	42		Act takes effect September 1, 2015.
