13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 1040.052, Special District Local Laws |
---|
15 | 9 | | Code, is amended to read as follows: |
---|
16 | 10 | | Sec. 1040.052. QUALIFICATIONS FOR OFFICE. (a) A person may |
---|
17 | 11 | | not be appointed as a director unless the person[: |
---|
18 | 12 | | [(1)] is a district resident[; and |
---|
19 | 13 | | [(2) owns land in the district subject to taxation]. |
---|
20 | 14 | | (b) A person may not be appointed as a director if the person |
---|
21 | 15 | | is: |
---|
22 | 16 | | (1) a district employee; or |
---|
23 | 17 | | (2) an employee of Haskell County. |
---|
24 | 18 | | SECTION 2. Section 1040.152(c), Special District Local Laws |
---|
25 | 19 | | Code, is amended to read as follows: |
---|
26 | 20 | | (c) Any district resident [taxpayer] is entitled to: |
---|
27 | 21 | | (1) appear at the time and place designated in the |
---|
28 | 22 | | notice; and |
---|
29 | 23 | | (2) be heard regarding any item included in the |
---|
30 | 24 | | proposed budget. |
---|
31 | 25 | | SECTION 3. Section 1040.153, Special District Local Laws |
---|
32 | 26 | | Code, is amended to read as follows: |
---|
33 | 27 | | Sec. 1040.153. FISCAL YEAR. The district operates on a |
---|
34 | 28 | | fiscal year established by the board [that begins on October 1 and |
---|
35 | 29 | | ends on September 30]. |
---|
36 | 30 | | SECTION 4. Section 1040.154(b), Special District Local Laws |
---|
37 | 31 | | Code, is amended to read as follows: |
---|
38 | 32 | | (b) The audit shall be open to inspection during regular |
---|
39 | 33 | | business hours [Not later than December 31 each year, the audit |
---|
40 | 34 | | shall be filed: |
---|
41 | 35 | | [(1) with the comptroller; and |
---|
42 | 36 | | [(2)] at the district's principal [district] office. |
---|
43 | 37 | | SECTION 5. Section 1040.155(a), Special District Local Laws |
---|
44 | 38 | | Code, is amended to read as follows: |
---|
45 | 39 | | (a) The board by resolution shall designate a bank or banks |
---|
46 | 40 | | [in Haskell County] as the district's depository [or treasurer. A |
---|
47 | 41 | | designated bank serves for two years and until a successor is |
---|
48 | 42 | | designated]. |
---|
49 | 43 | | SECTION 6. Subchapter E, Chapter 1040, Special District |
---|
50 | 44 | | Local Laws Code, is amended by adding Sections 1040.207, 1040.208, |
---|
51 | 45 | | and 1040.209 to read as follows: |
---|
52 | 46 | | Sec. 1040.207. REVENUE BONDS. (a) The board may issue |
---|
53 | 47 | | revenue bonds to: |
---|
54 | 48 | | (1) purchase, construct, acquire, repair, renovate, |
---|
55 | 49 | | or equip buildings or improvements for hospitals and the hospital |
---|
56 | 50 | | system; or |
---|
57 | 51 | | (2) acquire sites to be used for hospital purposes. |
---|
58 | 52 | | (b) The bonds must be payable from and secured by a pledge of |
---|
59 | 53 | | all or part of the revenue derived from the operation of the |
---|
60 | 54 | | district's hospital system. |
---|
61 | 55 | | (c) The bonds may be additionally secured by a mortgage or |
---|
62 | 56 | | deed of trust on all or part of the district's property. |
---|
63 | 57 | | (d) The bonds must be issued in the manner and in accordance |
---|
64 | 58 | | with the procedures and requirements prescribed by Sections |
---|
65 | 59 | | 264.042, 264.043, 264.046, 264.047, 264.048, and 264.049, Health |
---|
66 | 60 | | and Safety Code, for issuance of revenue bonds by a county hospital |
---|
67 | 61 | | authority. |
---|
68 | 62 | | Sec. 1040.208. ADDITIONAL MEANS OF SECURING REPAYMENT OF |
---|
69 | 63 | | BONDS. In addition to the authority to issue general obligation |
---|
70 | 64 | | bonds and revenue bonds under this subchapter, the board may |
---|
71 | 65 | | provide for the security and payment of district bonds from a pledge |
---|
72 | 66 | | of a combination of ad valorem taxes as authorized by Section |
---|
73 | 67 | | 1040.202 and revenue and other sources as authorized by Section |
---|
74 | 68 | | 1040.207. |
---|
75 | 69 | | Sec. 1040.209. USE OF BOND PROCEEDS. The district may use |
---|
76 | 70 | | the proceeds of bonds issued under this subchapter to pay: |
---|
77 | 71 | | (1) any expense the board determines is reasonable and |
---|
78 | 72 | | necessary to issue, sell, and deliver the bonds; |
---|
79 | 73 | | (2) interest payments on the bonds during a period of |
---|
80 | 74 | | acquisition or construction of a project or facility to be provided |
---|
81 | 75 | | through the bonds, not to exceed five years; |
---|
82 | 76 | | (3) costs related to the operation and maintenance of |
---|
83 | 77 | | a project or facility to be provided through the bonds: |
---|
84 | 78 | | (A) during an estimated period of acquisition or |
---|
85 | 79 | | construction, not to exceed five years; and |
---|
86 | 80 | | (B) for one year after the project or facility is |
---|
87 | 81 | | acquired or constructed; |
---|
88 | 82 | | (4) costs related to the financing of the bond funds, |
---|
89 | 83 | | including debt service reserve and contingency funds; |
---|
90 | 84 | | (5) costs related to the bond issuance; |
---|
91 | 85 | | (6) costs related to the acquisition of land or |
---|
92 | 86 | | interests in land for a project or facility to be provided through |
---|
93 | 87 | | the bonds; and |
---|
94 | 88 | | (7) construction costs of a project or facility to be |
---|
95 | 89 | | provided through the bonds, including the payment of related |
---|
96 | 90 | | professional services and expenses. |
---|
97 | 91 | | SECTION 7. Section 1040.053(b), Special District Local Laws |
---|
98 | 92 | | Code, is repealed. |
---|
99 | 93 | | SECTION 8. This Act takes effect immediately if it receives |
---|
100 | 94 | | a vote of two-thirds of all the members elected to each house, as |
---|
101 | 95 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
102 | 96 | | Act does not receive the vote necessary for immediate effect, this |
---|
103 | 97 | | Act takes effect September 1, 2015. |
