99 relating to a task force to study methods to prevent the theft of
1010 desert plants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 12, Agriculture Code, is amended by
1313 adding Section 12.052 to read as follows:
1414 Sec. 12.052. STUDY OF METHODS TO PREVENT DESERT PLANT
1515 THEFT. (a) Not later than December 1, 2015, the commissioner shall
1616 appoint a task force to study methods to prevent the theft of desert
1717 plants from private property, including the following genera of
1818 plants:
1919 (1) Agave;
2020 (2) Ariocarpus;
2121 (3) Echinocactus;
2222 (4) Echinocereus;
2323 (5) Ferocactus;
2424 (6) Fouquieria;
2525 (7) Mammillaria; and
2626 (8) Yucca.
2727 (b) The task force shall study the sale and transportation
2828 of desert plants and methods to prevent the theft of desert plants
2929 from private property. The task force may study the feasibility and
3030 effectiveness of:
3131 (1) implementing registration requirements for
3232 persons who sell or transport desert plants;
3333 (2) requiring persons who sell or transport desert
3434 plants to enter into a compliance agreement with a state agency;
3535 (3) requiring persons who sell or transport desert
3636 plants to document the origin of the plants;
3737 (4) authorizing a state agency to issue stop-sale
3838 orders regarding or to seize desert plants that do not comply with
3939 legal requirements;
4040 (5) imposing civil, criminal, or administrative
4141 penalties for persons who steal desert plants and for persons who
4242 fail to comply with legal requirements governing the sale or
4343 transportation of desert plants; and
4444 (6) taking any other action to regulate the sale or
4545 transportation of desert plants and prevent the theft of desert
4646 plants, as determined by the task force.
4747 (c) Not later than December 1, 2016, the task force shall
4848 submit to the house committees on agriculture and livestock and
4949 appropriations a report that includes recommendations for
5050 legislation to regulate the sale or transportation of desert plants
5151 and prevent the theft of desert plants from private property.
5252 (d) This section expires December 31, 2016.
5353 SECTION 2. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2015.
