55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to administering certain assessment instruments to public
88 school students in certain grades for diagnostic purposes only.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.023, Education Code, is amended by
1111 adding Subsection (a-12) to read as follows:
1212 (a-12) Notwithstanding any other law, an assessment
1313 instrument administered to students under Subsection (a) in social
1414 studies or in writing may be used only for the purpose of diagnosing
1515 the academic strengths and deficiencies of students. The results of
1616 assessment instruments administered to students under Subsection
1717 (a) in social studies or in writing may not be used for purposes of
1818 the determination of accreditation status for school districts or
1919 performance ratings or distinction designations for school
2020 districts or campuses under this chapter.
2121 SECTION 2. Section 39.203(c), Education Code, is amended to
2222 read as follows:
2323 (c) In addition to the distinction designations described
2424 by Subsections (a) and (b), a campus that satisfies the criteria
2525 developed under Section 39.204 shall be awarded a distinction
2626 designation by the commissioner for outstanding performance in
2727 academic achievement in English language arts, mathematics, or
2828 science[, or social studies].
2929 SECTION 3. This Act applies beginning with the 2015-2016
3030 school year.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2015.
