7 | 7 | | relating to the operation and movement of motorcycles during |

8 | 8 | | periods of traffic congestion. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 545.060, Transportation Code, is amended |
---|
11 | 11 | | by amending Subsection (a) and adding Subsection (e) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) An operator on a roadway divided into two or more |
---|
14 | 14 | | clearly marked lanes for traffic: |
---|
15 | 15 | | (1) shall drive as nearly as practical entirely within |
---|
16 | 16 | | a single lane, except as provided by Subsection (e); and |
---|
17 | 17 | | (2) may not move from the lane unless that movement can |
---|
18 | 18 | | be made safely. |
---|
19 | 19 | | (e) The operator of a motorcycle may operate the motorcycle |
---|
20 | 20 | | for a safe distance between lanes of traffic moving in the same |
---|
21 | 21 | | direction during periods of traffic congestion if: |
---|
22 | 22 | | (1) notwithstanding Section 661.003(c), the operator |
---|
23 | 23 | | and any passenger wear protective headgear that meets the safety |
---|
24 | 24 | | standards adopted by the department; and |
---|
25 | 25 | | (2) the operator operates the motorcycle: |
---|
26 | 26 | | (A) at a speed not more than five miles per hour |
---|
27 | 27 | | greater than the speed of the other traffic; |
---|
28 | 28 | | (B) in traffic that is moving at a speed of 20 |
---|
29 | 29 | | miles per hour or less; and |
---|
30 | 30 | | (C) in a location other than a school crossing |
---|
31 | 31 | | zone or a location where the posted speed limit is 20 miles per hour |
---|
32 | 32 | | or less. |
---|
33 | 33 | | SECTION 2. This Act takes effect September 1, 2015. |
