55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation and movement of motorcycles during
88 periods of traffic congestion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.060, Transportation Code, is amended
1111 by amending Subsection (a) and adding Subsection (e) to read as
1212 follows:
1313 (a) An operator on a roadway divided into two or more
1414 clearly marked lanes for traffic:
1515 (1) shall drive as nearly as practical entirely within
1616 a single lane, except as provided by Subsection (e); and
1717 (2) may not move from the lane unless that movement can
1818 be made safely.
1919 (e) The operator of a motorcycle may operate the motorcycle
2020 for a safe distance between lanes of traffic moving in the same
2121 direction during periods of traffic congestion if:
2222 (1) notwithstanding Section 661.003(c), the operator
2323 and any passenger wear protective headgear that meets the safety
2424 standards adopted by the department; and
2525 (2) the operator operates the motorcycle:
2626 (A) at a speed not more than five miles per hour
2727 greater than the speed of the other traffic;
2828 (B) in traffic that is moving at a speed of 20
2929 miles per hour or less; and
3030 (C) in a location other than a school crossing
3131 zone or a location where the posted speed limit is 20 miles per hour
3232 or less.
3333 SECTION 2. This Act takes effect September 1, 2015.
