8	8	AN ACT
9	9	relating to a certificate of birth resulting in stillbirth.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 192.0022(a)(1), Health and Safety Code,
12	12	is amended to read as follows:
13	13	(1) "Stillbirth" means an unintended, intrauterine
14	14	fetal death occurring in this state [after a gestational age of not
15	15	less than 20 completed weeks].
16	16	SECTION 2. Section 192.0022, Health and Safety Code, as
17	17	amended by S.B. 219, Acts of the 84th Legislature, Regular Session,
18	18	2015, is amended by amending Subsections (b), (c), (g), and (h) and
19	19	adding Subsections (d-1) and (h-1) to read as follows:
20	20	(b) The person who is required to file a fetal death
21	21	certificate under Section 193.002, if that person is required to
22	22	file a fetal death certificate or is otherwise involved in the
23	23	disposition of the stillborn child's remains, shall advise the
24	24	parent or parents of a stillborn child:
25	25	(1) that a parent may, but is not required to, request
26	26	the preparation of a certificate of birth resulting in stillbirth;
27	27	(2) that a parent may obtain a certificate of birth
28	28	resulting in stillbirth by contacting the vital statistics unit to
29	29	request the certificate and paying the required fee; and
30	30	(3) regarding the way or ways in which a parent may
31	31	contact the vital statistics unit to request the certificate.
32	32	(c) A parent may provide a name for a stillborn child on the
33	33	request for a certificate of birth resulting in stillbirth. If the
34	34	requesting parent does not wish to provide a name, the vital
35	35	statistics unit shall fill in the certificate with the name "baby
36	36	boy" or "baby girl" and the last name of the parent. [The name of
37	37	the stillborn child provided on or later added by amendment to the
38	38	certificate of birth resulting in stillbirth shall be the same name
39	39	as placed on the original or amended fetal death certificate.]
40	40	(d-1) The department shall issue a certificate of birth
41	41	resulting in stillbirth at the request of a parent of the stillborn
42	42	child.
43	43	(g) On issuance of a certificate of birth resulting in
44	44	stillbirth to a parent who has requested the certificate as
45	45	provided by this section, the vital statistics unit shall file an
46	46	exact copy of the certificate with the local registrar of the
47	47	registration district in which the stillbirth occurred. [The
48	48	local registrar shall file the certificate of birth resulting in
49	49	stillbirth with the fetal death certificate.]
50	50	(h) A parent may request the vital statistics unit to issue
51	51	a certificate of birth resulting in stillbirth without regard to
52	52	the date on which the birth resulting in stillbirth occurred [fetal
53	53	death certificate was issued].
54	54	(h-1) A certificate of birth resulting in stillbirth is not
55	55	a certificate of fetal death for purposes of Section 193.002, and
56	56	the issuance of a certificate of birth resulting in stillbirth
57	57	under this section does not affect the issuance of a certificate of
58	58	fetal death under Section 193.002.
59	59	SECTION 3. Section 192.0022(d), Health and Safety Code, is
60	60	repealed.
61	61	SECTION 4. This Act takes effect September 1, 2015.
