99 relating to a certificate of birth resulting in stillbirth.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 192.0022(a)(1), Health and Safety Code,
1212 is amended to read as follows:
1313 (1) "Stillbirth" means an unintended, intrauterine
1414 fetal death occurring in this state [after a gestational age of not
1515 less than 20 completed weeks].
1616 SECTION 2. Section 192.0022, Health and Safety Code, as
1717 amended by S.B. 219, Acts of the 84th Legislature, Regular Session,
1818 2015, is amended by amending Subsections (b), (c), (g), and (h) and
1919 adding Subsections (d-1) and (h-1) to read as follows:
2020 (b) The person who is required to file a fetal death
2121 certificate under Section 193.002, if that person is required to
2222 file a fetal death certificate or is otherwise involved in the
2323 disposition of the stillborn child's remains, shall advise the
2424 parent or parents of a stillborn child:
2525 (1) that a parent may, but is not required to, request
2626 the preparation of a certificate of birth resulting in stillbirth;
2727 (2) that a parent may obtain a certificate of birth
2828 resulting in stillbirth by contacting the vital statistics unit to
2929 request the certificate and paying the required fee; and
3030 (3) regarding the way or ways in which a parent may
3131 contact the vital statistics unit to request the certificate.
3232 (c) A parent may provide a name for a stillborn child on the
3333 request for a certificate of birth resulting in stillbirth. If the
3434 requesting parent does not wish to provide a name, the vital
3535 statistics unit shall fill in the certificate with the name "baby
3636 boy" or "baby girl" and the last name of the parent. [The name of
3737 the stillborn child provided on or later added by amendment to the
3838 certificate of birth resulting in stillbirth shall be the same name
3939 as placed on the original or amended fetal death certificate.]
4040 (d-1) The department shall issue a certificate of birth
4141 resulting in stillbirth at the request of a parent of the stillborn
4242 child.
4343 (g) On issuance of a certificate of birth resulting in
4444 stillbirth to a parent who has requested the certificate as
4545 provided by this section, the vital statistics unit shall file an
4646 exact copy of the certificate with the local registrar of the
4747 registration district in which the stillbirth occurred. [The
4848 local registrar shall file the certificate of birth resulting in
4949 stillbirth with the fetal death certificate.]
5050 (h) A parent may request the vital statistics unit to issue
5151 a certificate of birth resulting in stillbirth without regard to
5252 the date on which the birth resulting in stillbirth occurred [fetal
5353 death certificate was issued].
5454 (h-1) A certificate of birth resulting in stillbirth is not
5555 a certificate of fetal death for purposes of Section 193.002, and
5656 the issuance of a certificate of birth resulting in stillbirth
5757 under this section does not affect the issuance of a certificate of
5858 fetal death under Section 193.002.
5959 SECTION 3. Section 192.0022(d), Health and Safety Code, is
6060 repealed.
6161 SECTION 4. This Act takes effect September 1, 2015.
