104 AN ACT
115 relating to the abolishment of the Orange County child support
126 office and to the divorce and contempt fees paid in Orange County.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Sections 152.1872(f) and (g), Human Resources
159 Code, are transferred to Section 152.1873, Human Resources Code,
1610 redesignated as Subsections (f) and (g) of that section, and
1711 amended to read as follows:
1812 (f) Fees collected under this section [and Section
1913 152.1873] shall be deposited in a separate fund known as the
2014 "divorce and contempt fees fund [Child Support Fund]" by the county
2115 treasurer. A record shall be kept of all fees collected and
2216 expended. The divorce and contempt fees [child support] fund is
2317 subject to regular audit by the county auditor or other authorized
2418 person. An annual report of receipts and expenditures in the
2519 account shall be made to the commissioners court by the auditor.
2620 (g) The Orange County Juvenile Board [juvenile board] shall
2721 administer the fees collected under this section [and Section
2822 152.1873] to meet the expenses of the juvenile board [office],
2923 including postage, equipment, stationery, office supplies,
3024 subpoenas, salaries, and other expenses authorized by the board.
3125 The fund shall be supplemented from the general fund or other
3226 available funds of the county as necessary.
3327 SECTION 2. The heading to Section 152.1873, Human Resources
3428 Code, is amended to read as follows:
3529 Sec. 152.1873. DIVORCE [ADOPTION] AND CONTEMPT FEES IN
3630 ORANGE COUNTY.
3731 SECTION 3. Sections 152.1873(a) and (d), Human Resources
3832 Code, are amended to read as follows:
3933 (a) Each person who files a divorce case in Orange County
4034 shall pay to the clerk of the district court a filing fee of not less
4135 than $5. The fee is taxed, collected, and paid as other costs and is
4236 used to assist in maintaining the Orange County Juvenile Board as
4337 provided by Subsection (g) [child support office].
4438 (d) A receipt of all disbursements of money paid to [into]
4539 the Orange County Juvenile Board [child support office] in a matter
4640 involving contempt shall be kept on file.
4741 SECTION 4. The following are repealed:
4842 (1) the heading to Section 152.1872, Human Resources
4943 Code; and
5044 (2) Sections 152.1872(a), (b), (c), (d), and (e),
5145 Human Resources Code.
5246 SECTION 5. On the effective date of this Act:
5347 (1) the Orange County child support office is
5448 abolished;
5549 (2) the obligations, rights, records, equipment, and
5650 personnel of the former office are transferred to the Orange County
5751 Juvenile Board; and
5852 (3) any money remaining in the Orange County child
5953 support fund shall be transferred to the divorce and contempt fees
6054 fund for the Orange County Juvenile Board.
6155 SECTION 6. This Act takes effect September 1, 2015.
