| 14 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 15 | 9 | SECTION 1. Section 3, Article 42.09, Code of Criminal | |
| 16 | 10 | Procedure, is amended to read as follows: | |
| 17 | 11 | Sec. 3. If a defendant [is] convicted of a felony is [and] | |
| 18 | 12 | sentenced to death or to [,] life [, or a term of more than ten | |
| 19 | 13 | years] in the Texas Department of Criminal Justice or is ineligible | |
| 20 | 14 | for release on bail pending appeal under Article 44.04(b) and [he] | |

| 22 | 16 | the department on a commitment pending a mandate from the court of | |
| 23 | 17 | appeals or the Court of Criminal Appeals. | |
