104 AN ACT
115 relating to the transfer of certain inmates to the Texas Department
126 of Criminal Justice following pronouncement of the inmate's
137 sentence.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 3, Article 42.09, Code of Criminal
1610 Procedure, is amended to read as follows:
1711 Sec. 3. If a defendant [is] convicted of a felony is [and]
1812 sentenced to death or to [,] life [, or a term of more than ten
1913 years] in the Texas Department of Criminal Justice or is ineligible
2014 for release on bail pending appeal under Article 44.04(b) and [he]
2115 gives notice of appeal, the defendant [he] shall be transferred to
2216 the department on a commitment pending a mandate from the court of
2317 appeals or the Court of Criminal Appeals.
2418 SECTION 2. This Act takes effect September 1, 2015.
